WHEREAS,The County has North Carolina General Statute 153A-149(c)(30) authorizes <br /> the County to expend funds for providing for the public welfare through the maintenance and <br /> administration of public assistance programs not specifically authorized under the Department <br /> of Social Services Chapter such as addressing the homeless needs in the County, and; <br /> WHEREAS, Outreach Mission Inc., is a non-profit corporation serving the public purpose <br /> of providing shelter for homeless persons in the City and the County, and; <br /> WHEREAS,the Outreach Mission Inc., by and through its board of directors has sought a <br /> donation of the property located at 304 Oakwood Avenue in order to provide a new shelter for <br /> its clients and has agreed to use the property in furtherance of its public purpose and if the <br /> Outreach Mission no longer uses the property for the public purpose of addressing <br /> homelessness,then the property will revert back to the County. <br /> NOW THEREFORE, BE IT RESOLVED by the Lee County Board of Commissioners as <br /> follows: <br /> 1. That the lot located at 304 Oakwood Avenue, PIN 9642-98-3679 is hereby declared <br /> to be surplus to the needs of Lee County. <br /> 2. That the consideration for the conveyance is based on the following set of <br /> conditions, covenants and restrictions which shall be incorporated in the deed given <br /> by the County to the Outreach Mission, Inc. and which include: <br /> a. The Outreach Mission Inc. will seek federal grant funding to help erect a <br /> homeless shelter on the parcel. <br /> b. Once the shelter is completed, Outreach Mission Inc. will operate said <br /> homeless shelter to benefit the homeless population and the Outreach <br /> Mission Inc. will not discriminate based on anyone's race, color, religion, sex <br /> or national origin. <br /> c. The Outreach Mission Inc. will submit an annual report to the County <br /> summarizing the programs has offered throughout the year. <br /> d. The deed will contain a clause that the property must be used for the public <br /> purpose of providing homeless shelter to the population of the County of Lee <br /> and in the event the property described above ceases to be used for the <br /> aforesaid public purpose,then in such event all right,title, and interest in the <br /> property will revert back to the County and the County shall have the right to <br /> immediately re-enter upon said premises and take and hold possession of <br /> said premises without let or hindrance. <br /> 3. That the Clerk to the Board is hereby authorized and directed to cause a notice <br /> summarizing the contents of this resolution to be published once in The Sanford <br />
