C. Consideration of a zoning map amendment (rezoning) request for 3284 Farrell Road. <br /> An application was submitted by Copper Ridge Development, LLC to rezone one <br /> approximately 30.25 acre tract of land addressed as 3284 Farrell Road from Residential <br /> Agricultural to Copper Ridge Estates Conditional Zoning District for the purpose of <br /> developing residential single-family home subdivision. The subject property is identified as <br /> tax parcel 9666-44-0337-00 as depicted on Lee County Tax Map 9666.03. The Lee County <br /> Planning Board voted to recommend denial of this request by a unanimous vote based on <br /> the rationale that neither the former long-range land use plan nor the recently adopted <br /> long-range land use plan support this request. Two votes are required by the <br /> Commissioners when addressing the rezoning request. Commissioner Smith made a <br /> motion that the request is not consistent with the adopted long-range plan as the request is <br /> to rezone to allow a minimum lot size of 20,000 sf as opposed to the recommended <br /> maximum development density of one dwelling unit per two acres. Upon a vote, the results <br /> were as follows: <br /> Aye: Dalrymple, Del Palazzo, Dodson, Knecht, Revies, Sharpe, Smith <br /> Nay: None <br /> Chair Dalrymple ruled the motion had carried unanimously. <br /> Commissioner Smith made a motion that the proposed zoning map amendment is <br /> reasonable and in the public interest based on the following: the current zoning of <br /> Residential Agricultural (RA) allows 40,000 sf lots or 33 total lots on this site (not taking <br /> into consideration the acreage required for roadways or the suitability of the soil for private <br /> septic systems) and the developer is proposing to create 24 lots based on the subdivision <br /> sketch submitted with the rezoning application. Therefore, I move to approve the request <br /> to rezone one 30.25 +1- acre tract of land addressed as 3284 Farrell Road from Residential <br /> Agricultural (RA) to Copper Ridge Estates Conditional Zoning District for the purpose of <br /> developing a residential single-family home subdivision. Following a discussion on the <br /> ability to make a motion to approve following the approval of the motion declaring the <br /> proposal inconsistent with the current land use plan, Commissioner Smith moved to <br /> withdraw his motion. <br /> Commissioner Reives then made a motion that the proposed zoning map <br /> amendment is not reasonable and not in the public interest based on the following: the <br /> request is not consistent with the adopted long range land use plan and the current zoning <br /> for Residential Agricultural (RA) allows 40,000 sf lots (not taking into consideration the <br /> acreage required for roadways or the suitability of the soil for private septic systems) of <br /> which there are several in the area, but to allow smaller lots would be inconsistent with <br /> current development trends in the area. Therefore, I move to deny the request to rezone <br /> one 30.25 +1- acre tract of land addressed as 3284 Farrell Road from Residential <br /> Page 416 <br />
