r <br />NORTH CAROLINA ) A rr�� <br />LEE COUNTY j cnrh ?� P;' . <br />LICENSE AGREEMENT <br />LEE COUNTY INNOVATION CENTER <br />THIS AGREEMENT, made and entered into this � day of <br />2011, by and between the County of Lee, hereinafter referred to as <br />"Coun " and Central Carolina Community College, hereinafter referred to as "College" <br />WITNESSETH: <br />WHEREAS, the County is the owner of a certain parcel of land and building formerly <br />owned by Trans -Matic Manufacturing Company located at 5825 Clyde Rhyne Drive in the <br />Lee County Industrial Park and is now known as the Lee County Innovation Center; and <br />WHEREAS, the College has a commitment to Caterpillar, Inc. to train certain of its <br />employees and prospective employees in connection with Caterpillar's industrial expansion <br />in Lee County and will use the facility for other training programs in the future; and <br />WHEREAS, the parties enter into this agreement to define their respective rights, <br />duties, and liabilities relating to the premises at 5825 Clyde Rhyne Drive; <br />In consideration of the mutual covenants, agreements, and stipulations contained in <br />the agreement, the parties agree as follows: <br />1. County hereby grants the College a license to occupy and use, subject <br />to all of the terms and conditions of this agreement, certain County <br />facilities herein described beginning on August 1, 2011. <br />2. The space allotted to the College for its industrial training activities is <br />shown on the floor plan diagram attached to this agreement as <br />Attachment 1 and incorporated by reference into this agreement. <br />3. Employees of the College and its trainees shall have the use of the <br />restroom, break room, and parking facilities located at the facility. <br />4. The above described spaces shall be occupied and used by the College <br />solely for its training programs and for incidental purposes related to <br />such programs. <br />5. Employees or representatives of the College are not to be considered <br />County employees or agents for any purpose including, but not limited <br />to, the accrual of any employee benefits. The College is not authorized <br />to represent the County or otherwise bind the County in any dealings <br />between the College and third parties. Employees or custodians <br />
