BOOK i2 NGE s7s <br />Senators representing Lee County in the General Assembly are requested <br />to introduce and seek the enactment of legislation authorizing that the <br />leasehold deed of trust between Floyd Browne Associates, Inc., its <br />successors or assigns, and the Southern National Bank of North Carolina, <br />be authorized to contain a provision in which Lee County may exercise a <br />right of first refusal to purchase the water treatment plant at the <br />balance of the indebtedness on the property within a reasonable period <br />prior to the institution of any foreclosure action by Southern National <br />Bank of North Carolina; <br />3. The appropriate County officers are authorized and <br />empowered to execute and deliver an amendment to the agreement for <br />funding, design, building and operation of the water treatment plant to <br />provide that if Southern National Bank of North Carolina has to secure <br />an engineering firm to operate the water treatment plant after Floyd <br />Browne Associates, Inc., its successors or assigns, default that any <br />increased costs allocated to the labor to operate the plant would be <br />passed on to Lee County in the form of higher water rates. <br />Commissioner Gordon A. Wicker seconded the motion and upon a <br />vote the results were as follows: <br />AYE: Dossenbach, Matthews, Wicker and Cox <br />NAY: Stafford <br />The Chairman declared the resolution had been unanimously <br />adopted. <br />Commissioner Bertha L. Matthews introduced a bond order which <br />was read at length as follows: <br />WHEREAS, THE Board of Commissioners of the County of Lee has <br />received and considered a resolution from the Lee County Board of <br />Education including a request that the Board of Commissioners provide <br />and improve additional school facilities in Lee County; and <br />WHEREAS, the Board of Commissioners has caused to be filed <br />with the Secretary of the Local Government Commission of North Carolina <br />an application for Commission approval of the bonds hereinafter <br />described as required by The Local Government Finance Act, and the <br />Secretary of the Local Government Commission has notified the Board that <br />the application has been filed and accepted for submission to the Local <br />Government Commission; <br />NOW, THEREFORE, BE IT ORDERED by the Board of Commissioners <br />of the County of Lee, as follows: <br />Section 1. The Board of Commissioners of the County of Lee has <br />asc ertained and hereby determines that it is necessary to improve <br />public school facilities in Lee County, including without limitation the <br />construction of an elementary school and including the acquisition and <br />-6- <br />
