Dossenbach, Jr. introduced and moved the <br />adoption of the following Resolution: <br />WHEREAS,the County of Lee has a contractural obligation to <br />furnish water to the Golden Poultry Company, Inc. industrial site near <br />Cumnock; and <br />WHEREAS, Golden Poultry Company, Inc. has conveyed to Lee <br />County a 10 acre site which tract of land is described in Exhibit A <br />attached hereto and by this reference made a part hereof, for use in <br />constructing a water treatment plant; and <br />WHEREAS,the most expeditious way the County can acquire a <br />water treatment plant and fulfill its obligation to Golden Pountry <br />Company, Inc. is to assist Floyd Browne Associates, Inc., its successors <br />or assigns, in fulfilling its agreement to fund, design and operate a <br />water treatment plant; and <br />WHEREAS, Southern National Bank of North Carolina has <br />required as a condition for the financing of the construction of said <br />water treatment plant that Lee County join in the execution of the <br />leasehold deed of trust on the water plant property thus subjecting Lee <br />County's interest therein to Southern National Bank of North Carolina's <br />deed of trust; and <br />WHEREAS, it requires authority from the General Assembly of <br />North Carolina before Lee County could join in the execution of such <br />instrument; and <br />WHERRAAR, the Board of Commissioners has determined it is in <br />the best interest of Lee County to seek such authority from the General <br />Assembly of North Carolina; <br />NOW, THEREFORE, BE IT RESOLVED by the Board of Commissioners <br />for Lee County as follows: <br />1. That the members of the House of Representatives and the <br />Senators representing Lee County in the General Assembly of North <br />Carolina are requested to introduce and seek the enactment of <br />legislation authorizing the County of Lee to join in the execution of <br />the leasehold deed of trust on the water treatment plant property, as <br />described in Exhibit A to this Resolution, with Floyd Browne Associates, <br />Inc. or its successors or assigns, in favor of Southern National Bank of <br />North Carolina; <br />2.
