The preliminary plan for this subdivision was approved prior
to the 1985 Subdivision Ordinance change which required paved streets in
such developments. Because of the remoteness of the property and the
extreme length of the road which leads into the subdivision, the
Planning Board has agreed to waive the ordinance requirements relative
to the excessive slope of the road and the construction of pipes under
the road in exchange for an agreement by the developer to require
maintenance of the slopes and drainage for a period of time not to
exceed ten years. The attorneys for the developer have prepared such
an agreement which binds Mr. Womack and his successors in title. On
this basis, the Planning Board has unanimously recommended approval of
this subdivision plat. Commissioner John R.
