MO V 12 Fast 744 <br />(a) In the event the Society ceases to exist, it agrees to <br />transfer ownership of the said animal shelter to a non-profit <br />organization acceptable to the County of Lee and the Society, to <br />be used for purposes consistent with the Society's present goals; <br />provided in such event the County shall have option to terminate <br />this contract immediately; provided further that if the Society <br />fails to find or transfer title to such non-profit corporation, <br />the County shall have the option to acquire fee simple title for <br />itself by paying outstanding encumbrances. <br />(b) The County agrees that should it acquire title to the <br />facility, that it shall continue to operate the facility as an <br />animal shelter and that it will not allow CCCC to control or to <br />obtain animals from the facility. <br />Section 3.2 Non-Discriminatory. Society will operate the <br />animal shelter for the use and benefit of the citizens of Lee <br />County and other citizens or groups of citizens the Society deems <br />appropriate, and make such available on fair, equal and <br />non-discriminatory prices and further, that in the operation and <br />use of said facility the Society will not, on the grounds of race, <br />color or national origin, discriminate or permit discrimination <br />against any person or groups of persons in any manner. <br />Section 3.3 Injured Animals. During the hours of 8:00 A.M. <br />to 5:00 P.M., Monday through Friday, of each week except for legal <br />holidays, the County animal control officers shall be responsible <br />for picking up all injured animals and administering appropriate <br />disposition. During all other hours the Society shall pick up <br />said injured animals for a charge of $10.00 per animal, which <br />charge shall be in addition to the service fee hereinafter <br />stated. <br />Section 3.4 Charges for Services. County agrees that <br />Society may set fees for services in connection with the operation <br />of said shelter and Society agrees that the fees set will be <br />reasonable and commensurate with the expense of providing such <br />service and the time and investment required. <br />Section 3.5 Audit. Society agrees that County may audit its <br />books biannually utilizing County personnel or an accounting firm <br />employed by the County. Society agrees to furnish space for such <br />auditors and to cooperate with them by furnishing the books, <br />records and documents necessary for such audit. <br />Section 3.6 Additional Reporants. Society agrees to furnish <br />written reports on its operations d financial status at <br />reasonable intervals as may be requested by the County Manager, <br />but no more frequently than monthly. <br />Section 3.7 Liaison Person. The County Commissioner who <br />serves on the Lee County Health Board shall be the liaison person <br />
