Staff Report Presented at the November 17"', 2008 Public Hearing 038 <br />Petition #2008-1202, Submitted by Bobby Branch <br />For a change to the Official Zoning Map of Lee County <br />• <br />REQUEST: Rezone from Residential Restricted District to Light Industrial District <br />LOCATION: 2122 Boone Trail Road (US Highway 421 N) <br />TAX PARCELS: 9634-26-8099, 9634-26-6262, 9634-26-5313 <br />TOWNSHIP: West Sanford <br />ADJACENT ZONING: North: Residential Restricted <br />South: Light Industrial and Settle-Shontz CZD (City of Sanford) <br />Fast: Residential Restricted <br />West Light Industrial and Residential Restricted <br />Site and Area Description <br />The property requested for rezoning is located on the east side of Boone Trail Road (US 421N) <br />approximately 1,600 feet southeast of the intersection of Boone Trail Road and Forestwood Park Road. <br />The subject property consists of three lots on approximately 6.35-acres of land. A single-family dwelling <br />and utility shed occupy the middle lot at 2122 Boone Trail Road. <br />Zoning surrounding the site is a combination of Residential Restricted (RR) and Light Industrial (1-1). <br />The areas to the north and east are zoned Residential Restricted and are undeveloped. The land adjoining <br />to the south is zoned Settle-Shontz Conditional Zoning District and is developed as Sanford Animal <br />Boarding and Grooming Facility. Further south of that tract, the land is zoned Light Industrial and is <br />developed as Parkdale Mills. J & G Machinery Inc., and Bost Distributing (Patterson Packing Company) <br />are located opposite the site and is also zoned Light Industrial. <br />• Staff Analysis <br />The subject property was formerly a 9.9-acre tract according to a plat entitled "O. F. Patterson Heirs", <br />prepared by J. Chandler Eakes, RLS in 1967, and recorded in Plat Cabinet 3, Slide 61, Lee County <br />Registry. A portion of the above tract was acquired by the State Highway Commission in 1971 for an <br />expansion of the right of way of US highway 421. <br />The site has over 850 feet of road frontage on Boone Trail Road/US highway 421, which is a State <br />maintained road. All newly proposed driveway connections will require a driveway permit from <br />NCDOT. <br />Public water and sewer is located on the Settle-Shontz tract which adjoins to the east of the subject <br />property. There may be options to extend these utilities to service the subject property. The developer <br />would need to verify with the City Public Works Department regarding connection to these public <br />utilities. Immediate development of the property will require a well and on-site septic system for waste <br />disposal. <br />The Residential Restricted District is established to provide areas for low-density single-family <br />developments. The Light Industrial (LI) district is established to provide for areas that contain a mix of <br />light manufacturing uses, office park and limited retail and service uses. LI districts should include areas <br />which continue the orderly development and concentration of light industrial uses. LI zones should be <br />located 'so as to have direct access to or within proximity to a major or minor thoroughfare. The <br />dimensional standards of the L.l district includes a 30' minimum building setback, and 0' mininxon rear <br />and side setbacks, and no maximum building height requirement. Some of the typical manufacturing uses <br />permitted in the LI district include food and beverage, machinery and equipment, pharmaceutical, textile <br />mills and apparel manufacturing. The LI district also permits retail establishments, and professional <br />offices. <br />2 of3 <br />
