Staff Report Presented at the November 17i', 2008 Public I Ica ring <br />Petition #2008-1201, Submitted by Faye Baker <br />For a change to the Official Zoning Map of Lee County <br />s <br />REQUEST: Rezone from Residential Restricted District to Residential Agricultural District <br />LOCATION: Valley Road, SR 1325 <br />LEE COUNTY TAX PARCELS: 9624-88-5061, 9624-87-6817 TOWNSHIP: West Sanford <br />ADJACENT ZONING: North, South and Gast: Residential Restricted (RR) <br />West: Residential Agricultural (RA) <br />Site and Area Description <br />The area requested for rezoning is on the west side of Valley Road beginning approximately 300 feet <br />southwest of the intersection of Forest-wood Park Road and Valley Road. The property consists of two <br />lots on approximately 4.30 acres of land. The lots are vacant and combined they have over 600 feet of <br />road frontage. <br />Adjoining properties north, south and east are zoned Residential Restricted. Properties adjoining <br />westward are zoned Residential Agricultural district. The primary land uses in the area are single-farnily <br />dwellings comprised of site-built homes and doublewide manuhtctured homes. <br />Public water is accessible to the property. A private on-site septic system is required for waste disposal. <br />This property is not located in a designated floodplain, but is located within the Deep River WS-IV water <br />supply watershed protected area. Development restrictions of the watershed should not affect the <br />placement of a single-family home on the property. <br />Staff Analysis and Description <br />® The applicant request that the property be rezoned from Residential Restricted (RR) district to Residential <br />Agricultural (RA) district so she may place a manufactured home on the property for her son. <br />Currently, the property is zoned Residential Restricted (RR) district. The RR district is established to <br />provide areas _I_or loy-density_single_family_ uses, with a maximum of-one and one-half (1.5) dwelling <br />units per acre. Property zoned RR should include only those tracts which abut or are in close proximity to <br />existing large-lot single family development, making RR an appropriate transition district between rural, <br />agricultural, and suburban uses. Housing types in the RR district are limited to site built homes and <br />modular homes. The minimum lot size allowed in the RR district is 30,000 square feet (.69 acres). The <br />minimum building setbacks include a street yard setback of 30 feet, side yard setbacks of 15 feet and a <br />rear yard setback of 30 feet. <br />The Residential Agricultural (RA) district is established to provide areas for low density single family <br />uses, low intensity agricultural operations as well as agri-business and supportive industrial and <br />commercial uses. The dimensional requirements of the Residential Agricultural district include a <br />minimum lot size of 40,000 square feet (.92 acres), or one unit per acre. The minimum building setbacks <br />are the same as required in the RR district (30' front, 30' rear and 15' side yard setbacks). The RA <br />district permits all housing types which includes manufactured homes. <br />Roth districts permit similar uses such as major subdivisions. bona fide farms and agricultural uses. The <br />major difference in the zoning districts are the housing types allowed. <br />Conformance with the 2020 Land Use Plan <br />The 2020 Land Use Plan and Map have not identified this area for any particular use. When considering <br />the zoning of the property, current development trends of the neighborhood should be continued and <br />applied. <br />s <br />
