0?3 <br />~g coU,y~y <br />• VHF p~ <br />o~ ~r <br />MEMORANDUM CARD` <br />TO: Lee County Board of Commissioners <br />John Crumpton, County Manager <br />O <br />FROM: Marshall Downey, Assistant Director of Community Development <br />DATE: December 1, 2008 <br />REF: Recommendation from the Planning Board regarding amendment to update the <br />Unified Development Ordinance (UDO) regarding sales of motorized scooters, <br />motorcycles, and ATVs in certain zoning districts. <br />The Board will recall that a public hearing was conducted at the October 20'h meeting <br />regarding changes to the UDO to exempt government-owned wireless communication facility <br />erected for the purposes of installing antenna(s) and ancillary equipment necessary to provide <br />public health and safety. For additional background, staff was recently approached by a <br />business owner who indicated a desire to sale motorized scooters at his current business <br />which is located in downtown Sanford. After reviewing the UDO, it was determined that the <br />sale and/or lease of these scooters falls under the category of Motor Vehicles, Boats, RV's <br />Sales and/or Leasing/Rental. It was also determined that. this land use--category . is not <br />permitted in the CBD zoning district. <br />In talking with this business owner, he indicated that his scooters would be indoor display <br />only, with no outdoor sidewalk displays. He asked staff about options and we suggested that <br />the best option would be to amend the LIDO to allow for the indoor sale and/or lease of <br />motorized scooters (along with motorcycles and/or ATVs) in the CBD district. Staff suggests <br />that outdoor sales of such products is not conducive to the storefront style of downtown. As <br />such, draft language for an amendment for indoor sales/lease in CBD and C-1 is attached for <br />your discussion and consideration. Please note, as proposed, this would only allow for <br />motorized scooters, motorcycles and all-terrain vehicles (ATVs). If so desired, the <br />amendment could be narrowed or expanded as desired. <br />The Planning Board discussed this item and it was recommended unanimously that the Board <br />of Commissioners consider adopting this amendment. The draft amendment is attached for <br />your consideration. <br />0 <br />
