078 <br />Section 2: AREAS WHERE SMOKING AND USE OF TOBACCO PRODUCTS <br />IS RESTRICTED <br />(A) The interior space of all county government buildings is declared to be <br />restricted areas in which no individual is permitted to smoke or use tobacco <br />products. <br />(B) The ground around a building wherein a component of either the Lee <br />County Health Department or the Lee County Department of Social <br />Services is housed is declared to be a restricted area in which no individual <br />is permitted to smoke or use tobacco products. <br />(C) The interior space of all public transportation vehicles is declared to be <br />restricted areas in which no individual is permitted to smoke or use tobacco <br />products. <br />Section 3: Enforcement and Penalties <br />(A) Employees who violate this ordinance may be subject to sanctions <br />consistent with the County's Personnel Policies in addition to the <br />punishment for the infraction. <br />0 (B) Employees and others who violate the provisions of this ordinance are <br />punishable for an infraction. <br />(C) Any one found responsible for an infraction of the ordinance shall for the <br />first infraction pay a penalty of $25.00 and the costs of court; for a second <br />infraction of this ordinance a penalty of $50.00 and the costs of court; and <br />for a third infraction of this ordinance and all future infractions a penalty of <br />$75.00 and the costs of court. <br />(D) Remedies: This ordinance may be enforced by equitable remedies in <br />accordance with North Carolina General Statutes Section 153A-123. <br />Section 4: Conflict of Laws <br />If any portion of this Ordinance or the enforcement thereof is found to be <br />preempted by State or Federal law, such preemption shall not operate to invalidate <br />the rest of the Ordinance and the same shall remain in full force and effect. All <br />Ordinances or parts of Ordinances in conflict with this Ordinance are hereby <br />repealed. <br />
