077 <br />LEE COUNTY DRAFT <br />REVISED <br />VCommitted Today for a Better Tomorrow <br />ORDINANCE RESTRICTING THE USE OR SMOKING <br />OF TOBACCO PRODUCTS IN COUNTY GOVERNMENT <br />BUILDINGS OR VEHICLES <br />WHEREAS, counties are granted broad police power authority to protect the <br />health, safety, and welfare of county employees and the general public by North <br />Carolina General Statute Section 153A-121 and authority to regulate the use of county <br />property by North Carolina General Statute Section 153A-169; and <br />WHEREAS, the Board of Commissioners has the authority to restrict smoking in <br />county government buildings and public transportation vehicles used by the public <br />pursuant to Article 23, Chapter 130A of the General Statutes of North Carolina, and <br />WHEREAS, The Board of Commissioners of the County of Lee desires to protect <br />the health of individuals working in or visiting county government buildings from the <br />is risks related to second hand smoke, <br />NOW, THEREFORE, BE IT ORDAINED by the Board of Commissioners of the <br />County of Lee as follows: <br />Section 1: DEFINITIONS <br />"Smoke" means the use or possession of a lighted cigarette, lighted cigar, lighted <br />pipe, or any other lighted tobacco product. <br />"Grounds" means the area located within fifty linear feet (50) of a building wherein <br />one or more components of the Lee County Health Department or one or more <br />components of the Lee County Department of Social Services are housed. <br />"Tobacco Projects" means any product that contains tobacco and is intended for <br />human use or consumption. <br />"County Government Building" means any building that is either owned by the <br />county or is leased by the county as lessor, or is leased by the county, as lessee or <br />any area in a building leased by the county as lessee and is occupied by the <br />county. <br />® "Public Transportation Vehicles" means vehicles owned or leased by the county <br />and used by the public. <br />
