073 <br />Section 22-70. Penalties for violation of this chapter. <br />IS (a) Criminal Penally: Any person violating this article shall be guilty of a <br />misdemeanor, punishable by a fine not to exceed $500.00 or imprisonment for not <br />more than thirty (30) days, or both as specified by G.S. 14.4. Each day's violation <br />shall be treated as a separate offense. <br />(b) Civil Penalty: A violation of this chapter shall subject the offender to the <br />assessment of a civil penalty not to exceed five hundred dollars (5500) as <br />provided in G.S. 153A-123. Penalties assessed shall be recovered by the county <br />in a civil action in the nature of debt if the offender does not pay the civil penalty <br />within thirty (30) days after the offender has been cited for the violation. Each <br />day's violation shall constitute a separate offense. <br />(c) Remedies. This article may be enforced by equitable remedies, and any <br />unlawful condition existing or in violation of this article may be enforced by <br />injunction and order of abatement in accordance with G.S. 153A-123. <br />ARTICLE XII. SEVERABILITY <br />Should any section, sentence, or part of this ordinance be for any reason held void or <br />invalid by a court of competent jurisdiction, it shall not affect the validity of any other <br />section, sentence, or part of this ordinance. <br />ARTICLE XIII. REPEAL OF CONFLICTING ORDINANCES <br />All ordinances and clauses of ordinances in conflict herewith are hereby repealed to the <br />extent of such conflict. <br />ARTICLE XIV. EFFECTIVE DATE <br />This ordinance shall be effective upon its adoption by the Board of Commissioners. <br />Adopted day of <br />2008 <br />Robert H.
