103 <br />MEMORANDUM <br />TO: Lee County Board of Commissioners <br />John Crumpton, County Manager <br />FROM: Marshall Downey, Assistant Director of Community Development <br />DATE: Sept.2, 2008 <br />REF: Consideration of adoption for proposed UDO amendment regarding accessory <br />dwellings in the R-10 and R-12 residential zoning districts. <br />This original amendment was under consideration for adoption in June, but was tabled by the <br />Sanford City Council to allow for additional research into option. Subsequently, this item <br />was also tabled by the County Commissioners to allow for the revisions to be made. The <br />primary change from the original draft is the removal of this accessory dwelling use from the <br />R-6 zoning district. <br />Please note that this amendment will only affect the R-10 and R-12 zoning districts which are <br />located only within the municipalities. This revised amendment was adopted by the City of <br />Sanford at their August 19th meeting and will be considered by the Town of Broadway at the <br />end of this month. Although this amendment will not affect the zoning jurisdiction of Lee <br />County, it should be considered for adoption to ensure consistency in the UDO. <br />Draft language - Section 10.4 Accessory Dwellings <br />10.4.1 Accessory dwellings shall only he permitted as set forth in Table 4.6-1 Permitted Use <br />Matrix of this Ordinance. <br />10.4.2 STANDARDS T 'OR ACCESSORY DWELLINGS. <br />• Only one (1) Accessory Dwelling shall be permitted per lot. <br />• An Accessory Dwelling unit shall be sited to the side or the rear of the principal <br />dwelling. <br />• An Accessory Dwelling unit shall meet all setback requirements as established for <br />principal uses within the zoning district within which it is located <br />• Adequate off-street parking shall be provided for any vehicles owned by occupants of <br />the Accessory Dwelling. Such parking areas shall not include grassed or turf areas. <br />11 <br />
