WHEREAS, the Board proposed to accept said offer unless an <br />upset bid shall be made and public notice was given as required <br />by law; and <br />WHEREAS, the Board received an upset bid within the time <br />allowed by law in the amount of $23,732.75; and <br />WHEREAS, the Board proposed to accept said bid for the <br />purchase of said property unless an upset bid shall be made and <br />public notice was given as required by law; and <br />WHEREAS, the Board received an upset bid within the time <br />allowed by law in the amount of $27,000; and <br />WHEREAS, the Board proposed to accept said bid for the <br />purchase of said property unless an upset bid shall be made and <br />public notice was given as required by law; and <br />WHEREAS, no upset bid was received during the time allowed <br />by law and as set out in said Public Notice; and <br />WHEREAS, said purchaser is ready, willing and able to <br />complete said sale. <br />NOW, THEREFORE, BE IT RESOLVED by the Board of <br />Commissioners of the County of Lee that upon the payment of the <br />sum of $27,000.00, the purchase price, by Loyd Lyons, the <br />successful bidder, the Chairman and Clerk are hereby authorized <br />and directed to execute a deed to Mr. Lyons or his designee for <br />the following described property: <br />BEING all of Lot No. 103 and Lot No. 104 as shown and <br />depicted on plat entitled "Map Showing the Alcott Property <br />of The Wilkins Supply Company, compiled from an actual <br />survey made in May, June and July, 1951, by Claude C. <br />McBryde, which map is of record in May Book 4, at page 41, <br />Lee County Registry, and to which map reference is hereby <br />made for a more perfect description. <br />Commissioner Stafford seconded the motion and upon a vote <br />the results were as follows: <br />Aye: Cox, Matthews, Stafford and Wicker <br />Nay: None <br />The Chairman ruled the Resolution passed unanimously. <br />The County Manager then reported on a Budget Amendment the <br />Board approved on February 5, 1990 for a Rip Rap Ditch at the <br />Sanford-Lee County Airport. The Board approved the allocation of <br />$4,300.00 of County funds as a match towards a State - Federal <br />Grant. The City of Sanford also agreed to a $4,300.00 match. <br />Mr. Joyce advised that the Airport Commission has negotiated a <br />tentative settlement to the violation of the Sedimentation <br />Pollution Control Act.
