fS00!; 1~ PArc j~~ Section 4. Determination of Enact Location of Zoning District Boundary Lines. The Zoning Administrator shall decide the exact location of zoning dis- trict boundary lines when a question arises concerning boundary lines shown on zoning maps, subject to administrative review by the Board. The deter- mination of the exact location of a zoning district's boundary line shall be guided by the provisions of Article V, Section 3. Section 5. Changes and Amendments. The Board of County Commissioners may, on their own motion or upon petition, after public notice and hearing, amend, supplement, change, modify, or repeal the regulations or maps herein subsequently established, subject to the rules and procedures established by law and more specifically established in the following subsections. (a) No regulation or map shall be amended, supplemented, changed, modi- fied, or repealed until after a public hearing in relation thereto, at which time parties in interest and citizens shall have an opportunity to be heard. A notice of such public hearing shall be given once a week for two (2) consecutive calendar weeks in a newspaper of general circu- lation in Lee County. The first such publication shall not be less than fifteen (15) days preceding the date set for such public hearing. Such public hearing may be adjourned from time to time or from place to place as the Board of County Commissioners may deem desirable. Notice shall also be provided by first class mail to owners of property adjoining the subject property. Such notice shall be mailed at least fifteen (15) days before the hearing date. (b) The Board of County Commissioners shall not take action on a proposal to amend the ordinance until a recommendation has been received from the Planning Board, provided that , if the Board does not submit a recommendatio n within sixty (60) days from the date the proposed amendment is first considered, the Board of County Commissioners may take action. The County shall state its reasons for any action taken and shall maintain a permanent record of all such actions. (c) All applications for amending the Zoning Ordinance or map shall be sub- mitted in duplicate to the Zoning Administrator on forms supplied by the office of the Zoning Administrator. Processing of such applications shall begin within forty-five (45) days from submission to the Planning Department. However, this requirement is not intended to prevent the Planning Board or Board of Commissioners from delaying action after review by either body. (d) There shall be a fee payable to Lee County for each application for rezoning. The amount of said fee shall be fixed by the Board of County Commissioners and shall be sufficient to defray all administrative costs incurred in processing the application, notifying adjacent property owners, obtaining technical assistance, and publishing the notice of public hearing. 67
