Determination of Enact Location of Zoning District Boundary Lines. <br />The Zoning Administrator shall decide the exact location of zoning dis- <br />trict boundary lines when a question arises concerning boundary lines shown <br />on zoning maps, subject to administrative review by the Board. The deter- <br />mination of the exact location of a zoning district's boundary line shall be <br />guided by the provisions of Article V, Section 3. <br />Section 5. Changes and Amendments. <br />The Board of County Commissioners may, on their own motion or upon <br />petition, after public notice and hearing, amend, supplement, change, modify, <br />or repeal the regulations or maps herein subsequently established, subject to <br />the rules and procedures established by law and more specifically established <br />in the following subsections. <br />(a) No regulation or map shall be amended, supplemented, changed, modi- <br />fied, or repealed until after a public hearing in relation thereto, at <br />which time parties in interest and citizens shall have an opportunity to <br />be heard. A notice of such public hearing shall be given once a week <br />for two (2) consecutive calendar weeks in a newspaper of general circu- <br />lation in Lee County. The first such publication shall not be less than <br />fifteen (15) days preceding the date set for such public hearing. Such <br />public hearing may be adjourned from time to time or from place to place <br />as the Board of County Commissioners may deem desirable. Notice shall <br />also be provided by first class mail to owners of property adjoining the <br />subject property. Such notice shall be mailed at least fifteen (15) days <br />before the hearing date. <br />(b) The Board of <br />County Commissioners <br />shall not take action <br />on a proposal <br />to amend the <br />ordinance until a recommendation has been <br />received from <br />the Planning <br />Board, provided that <br />, if the Board does <br />not submit a <br />recommendatio <br />n within sixty (60) <br />days from the date <br />the proposed <br />amendment is <br />first considered, the <br />Board of County Commissioners may <br />take action. <br />The County shall state <br />its reasons for any action taken and <br />shall maintain <br />a permanent record of <br />all such actions. <br />(c) All applications for amending the Zoning Ordinance or map shall be sub- <br />mitted in duplicate to the Zoning Administrator on forms supplied by the <br />office of the Zoning Administrator. Processing of such applications shall <br />begin within forty-five (45) days from submission to the Planning <br />Department. However, this requirement is not intended to prevent the <br />Planning Board or Board of Commissioners from delaying action after <br />review by either body. <br />(d) There shall be a fee payable to Lee County for each application for <br />rezoning. The amount of said fee shall be fixed by the Board of County <br />Commissioners and shall be sufficient to defray all administrative costs <br />incurred in processing the application, notifying adjacent property <br />owners, obtaining technical assistance, and publishing the notice of <br />public hearing. <br />67 <br />
