ARTICLE XIII
ADMINISTRATIVE AND LEGAL. PROVISIONS
Section 1. Administration of the Zoning Ordinance.
The Planning Director is designated as the Zoning Administrator of Lee
County and is hereby authorized, and it shall be his duty, to administer and
enforce the provisions of this ordinance. Appeal from a decision of the
Zoning Administrator may be made to the Board of Adjustment as provided in
Article XII.
Section 2. Zoning Permits.
(a) Before commencing the construction, erection, repair, alteration, addi-
tion to, removal, moving, or demolishing of any building or structure or
part thereof, or before commencing any excavation for such building or
structure, or before erecting, repairing, or repainting any sign (except
where specifically authorized by this ordinance), a zoning permit for the
same shall be secured from the Zoning Administrator.
(b) The Zoning Administrator shall not issue a zoning permit unless the
plans, specifications, and intended use of such buildings, structure,
land, or part thereof conform in all respects to the provisions of this
ordinance. The application for a zoning permit shall be accompanied by
such information as the Zoning Administrator may require to enable him
to act upon such application. In cases where an appeal is filed by the
applicant, or where he applied for a variance, the Zoning Administrator
shall forthwith transmit all of the papers pertaining to the application to
the Board for its action.
(c) If a building permit or a septic tank permit has been issued prior to the
adoption of this ordinance, no zoning permit is required and construction
may continue. Upon the effective date of this ordinance, a zoning
permit shall be required for all new improvements.
Section 3. Temporary Occupancy Permit for Class B and Class C Manufac-
tured Homes.
The owners of Class B and Class C manufactured homes may request a
temporary occupancy permit to allow them to occupy such residences for a
period of thirty (30) days. During this period of time, the required uniform
foundation enclosure of the unit is to be installed. All other required State
Building Codes must be adhered to prior to the request for the temporary
occupancy permit. Failure to comply with the uniform foundation enclosure
requirement of this ordinance within the specified time frame will result in the
withdrawal of the temporary occupancy permit and the appropriate penalty as
defined in Section 8 of Article XI11.
66
