no0 13 ?r,r 214 <br />Permit request. The person mailing such notice shall certify that such <br />notices have been mailed. In addition, the property for which the <br />special use is proposed shall be posted before the public hearing. <br />The Planning Board shall consider the application and comments at the <br />public hearing and may grant or deny the Special Use Permit request. <br />The Special Use Permit, if granted, shall include approval of plans as <br />may be required. In granting the permit, the Planning Board shall <br />find: <br />(1.) that the use will not materially endanger the public health or <br />safety if located where proposed and developed according to <br />the plan as submitted and approved; <br />(2) that the use meets all required conditions and specifications; <br />(3) that the use will not substantially injure the value of adjoin- <br />ing or abutting property, or that the use is a public neces- <br />sity; and <br />(4) that the location and character of the ~_.se. if developed <br />according to the plan and submitted and approved, will be in <br />harmony with the area in which it is to be located and in <br />general conformity with the Land Use Plan for Lee County. <br />In granting the Special Use Permit, the Planning Board may designate <br />only those conditions, in addition and in connection therewith, as will, <br />in its opinion, assure that the use in its proposed location will be har- <br />monious with the area in which it is proposed to be located, with the <br />spirit of this ordinance and clearly in keeping with the public welfare. <br />All such additional conditions shall be entered in the minutes of the <br />meeting at which the Special Use Permit is granted, on the Special Use <br />Permit itself, and on the approved plans submitted therewith. All spe- <br />cific conditions shall run with the land and shall be binding on the <br />original applicants for the Special Use Permit, their heirs, successors, <br />and assigns. <br />If the Board denies the Special Use Permit, it shall enter the reason for <br />its action in the minutes of the meeting at which the action is taken. <br />In addition to the conditions specifically imposed in this paragraph and <br />such further conditions as the Planning Board may deem reasonable and <br />appropriate, special uses shall comply with the height and area regula- <br />tions for the zoning district in which they are located unless the pro- <br />visions for the special use provide to the contrary. <br />In the event of failure to comply with the plans approved by the Plan- <br />ning Board or with any other conditions imposed upon the Special Use <br />Permit, the permit shall thereupon immediately become void and of no <br />effect. No building permits for further construction or certificates of <br />occupancy under this Special Use Permit shall be issued, and all com- <br />pleted structures shall be regarded as nonconforming uses subject to the <br />provisions of this ordinance, provided, however, that the County Board <br />of Commissioners shall not be prevented from thereafter rezoning said <br />property for its most appropriate use. <br />27 <br />
