R <br />boaK 13 Pau 213 <br />Section 4. Special Uses. <br />4.1 Objectives and Purposes <br />M <br />Permitting special uses adds flexibility to the Zoning Ordinance. Sub- <br />ject to high standards of planning and design, certain property uses are <br />allowed in the several districts where these uses would not otherwise be <br />acceptable. By means of controls exercised through the Special Use <br />Permit procedures, property uses which would otherwise be undesirable <br />in certain districts can be developed to minimize any bad effects they <br />might have on surrounding properties. <br />Those uses which existed prior to the effective date of this ordinance <br />and would only be permitted as special uses in the district in which they <br />are located, shall be considered to be legally established Special Uses <br />when this ordinance becomes effective. Any expansion, addition, or <br />other change for which a Special Use Permit is required shall be heard, <br />considered, and approved or disapproved by the Planning Board in the <br />same manner as an original application for a Special Use Permit. In the <br />case of the acquisition of additional real property by lease, purchase, or <br />other means, a Special Use Permit, or rezoning of the property, shall be <br />required before the acquired property may be used as a part of the <br />existing operation for which the Special Use Permit was granted. <br />The uses for which Special Use Permits are required are listed in the <br />chart preceding this section. Detailed description of the procedures <br />which must be followed in the issuance of each permit are contained in <br />the following pages. Uses specified in this section shall be permitted <br />only upon the issuance of a Special Use Permit. <br />4.2 Procedures <br />Special Use Permits shall be granted by the Lee County Planning Board <br />(as permitted by G.S. 153A-345 and authorized by resolution of the Lee <br />County Commissioners) for the uses enumerated in the Regulations for <br />Special Uses. <br />The owner or owners of all the property included in the petition for a <br />Special Use Permit shall submit five (5) copies of the application infor- <br />mation to the County Planning Director at least three (3) weeks prior to <br />the Planning Board meeting at which it is to be heard. Such application <br />shall include all of the requirements pertaining to it in this section. <br />All requests for Special Use Permits shall begin processing within ninety <br />(90) days from submission to the Planning Department. However, this <br />requirement is not intended to prevent the Planning Board or Board of <br />Commissioners from delaying action after review by either body. <br />The Planning Director shall set and advertise a date and time for a <br />public hearing before the Planning Board. Notice of such hearing shall <br />run in a newspaper of general local circulation at least fifteen (15) days <br />before the date set for the public hearing. At the public hearing, all <br />interested persons shall be permitted to testify. The Planning Director <br />shall also cause to be mailed at least ten (10) days before the hearing, a <br />first class letter to all adjoining property owners, the names of whom he <br />has made a good faith effort to obtain, notifying them of the Special Use <br />26 <br />
