Identical to the <br />Office and Institutional District except that a Conditional Use Permit is <br />required as a prerequisite to any use or development as provided in this <br />chapter. <br />HC, Highway Commercial District. The purpose of this district is to provide <br />a place in which the principal use of land is for the retailing of durable <br />goods, the provision of commercial services to industrial areas, and the pro- <br />vision of services to tourists. <br />HC-CU, Highway Commercial Conditional Use District. Identical to the High- <br />way Commercial District except that a Conditional Use Permit is required as a <br />prerequisite to any use or development as provided in this chapter. <br />LI, Light Industrial District. The LI District is established as a place for <br />light industrial, warehousing, and distribution and sales of large item pro- <br />ducts. <br />LI-CU, Light Industrial Conditional Use District. Identical to the Light <br />Industrial District except that a Conditional Use Permit is required as a pre- <br />requisite to any use or development as provided in this chapter. <br />HI, Heavy Industrial District. The HI District is designed to accommodate <br />those industries whose normal operations include dust, noise, odor, or other <br />emissions which may be deemed objectionable. <br />HI-CU, Heavy Industrial Conditional Use District. Identical to the Heavy <br />Industrial District except that a Conditional Use Permit is required as as pre- <br />requisite to any use or development as provided in this chapter. <br />Section 2. Conditional Use Districts. <br />It will be noted that a Conditional Use District (bearing the designation <br />CU) corresponds to each of the other districts authorized in this Zoning <br />Ordinance. It is the intent of this ordinance to create general use districts <br />in which a variety of uses are permitted and to also create conditional use <br />districts in which a single use is permitted upon the issuance by the Board of <br />Commissioners of a Conditional Use Permit prescribing the conditions under <br />which such use will be permitted. It is recognized by Lee County that cer- <br />tain types of zoning districts would be inappropriate at particular locations in <br />the absence of clearly defined conditions. <br />A Conditional Use Permit is appropriate only in rezoning cases and must <br />be applied for by the applicant for rezoning. Where the applicant for rezon- <br />ing desires property to be rezoned to such a district in such situations, the <br />Conditional Use District is a means by which specific conditions can be <br />imposed in the furtherance of the purpose of this chapter. Within a Condi- <br />tional Use District (sometimes referred to as a CUD), only those uses autho- <br />rized by Article VII as permitted in the zoning district with which the CUD <br />corresponds shall be permitted and all other requirements of the correspond- <br />ing district shall be met. In addition, within a CUD, no use shall be per- <br />mitted except pursuant to a Conditional Use Permit authorized by the Board <br />of County Commissioners which shall specify the use or uses authorized. <br />Such permit may further specify the location on the property of the proposed <br />16 <br />
