COMMENTS BY THE APPLICANT AS RECORDED <br />IN THE MINUTES OF THE AUGUST 15 "', 2011 PLANNING BOARD MEETING <br />At the planning board meeting, Mr. James Marty Thomas, Agent and Sales Manager for petroleum Recovery <br />Services stated the following: <br />"Mr. Thomas stated that Petroleum Recovery Services, LLC was an Environmental <br />Protection Agency (EPA) certified non - hazardous waste storage and disposal facility and <br />carry EPA license for non - hazardous material storage and disposal. <br />Mr. Thomas stated the tanks would have the capacity to hold 15,000 gallons each. <br />Mr. Thomas stated that the tanks were double - walled tanks wherein if the inner tank <br />ruptured any material that leaked out of the inner tank would then be captured inside the <br />outer tank layer. Also, the tanks would be grounded and bonded to protect against <br />electric shock as well as strapped to the ground with concrete anchors. The tanks will <br />have to be engineered to meet API and local fire code requirements. <br />Regarding the protection against spillage, Mr. Thomas stated that the company is required <br />to write a spill contingency plan which is reviewed and approved by the North Carolina <br />Department of Environment and Natural Resources. <br />Mr. Thomas stated that the company would not have the 15,000 gal. tanks initially but <br />would store approximately 3,000 — 5,000 gallons indoors which he had discussed with the <br />Lee County Fire Marshal. Also, the company is voluntarily placing a secondary <br />containment structure inside the facility which will be affixed to the floor of the building. <br />Mr. Thomas stated that Steven Burris, the owner of Petroleum Recovery Service, LLC, <br />would be the property owner contingent upon the decision of this rezoning request." <br />
