Hayes; Ed Paschal; Robert Reives; Dale Talbert; Kenneth Hoyle; <br />Susan Condlin; Shane Seagroves; Russell Spivey; Terrell Jones; William Heath Cain; Tommy Brooks <br />Cc: John Crumpton <br />Subject: Questions from August 16th Public Hearing <br />At the August 16" Commissioners meeting, a public hearing was held in reference to a rezoning request on behalf of <br />Petroleum Recover Services to rezone a parcel of land located at 3659 S. Plank Road from LI -CU district to South Plank <br />Rd LLC Conditional Zoning district. The change of use will include above ground storage tanks that will store diesel fuel <br />for emergency generators. The process includes sampling the fuel, treating it with inhibitor, removing water from the tank <br />and filtering the fuel when necessary. All work is done at the customers' locations. In the process of the work residual <br />water /fuel mixture is collected as well as used filters. The residual water /fuel mixture is brought back to the warehouse <br />where it will be consolidated into totes for collection by an authorized used oil collector. Filters are also brought back to <br />the warehouse to be crushed, drained and collected by an authorized used filter recycles The warehouse is used for <br />temporary storage for diesel fuel that contains water, rust and various other materials associated with degraded diesel <br />fuel. This material is commonly found in tank bottoms and is listed on the US EPA regulations as a Non - Hazardous <br />Waste. The warehouse will also be used to store small quantities of inhibitor which is used to stabilize fuel. Other uses of <br />the warehouse will include the storage of filters, hoses, pumps and other items used in the cleaning of fuel tanks. There <br />will be a need to have above ground storage tanks to contain combustible liquids (diesel fuel). <br />One gentleman at the public hearing stated he was not for or against the rezoning request but did have the following <br />questions: I was asked by Commissioners to provide these questions to departments to see if anyone has feedback or <br />responses in order to assist Planning staff with the rezoning request. <br />1. Will the operation be under EPA regulations, Clean Air, Clean Water Act or any federal, state of county <br />regulations? <br />2. Who has responsibility for soil, groundwater and air quality testing? How often will it be done and at whose <br />expense. <br />3. Will storage tanks withstand a hurricane, lighting strike or a tomado such as the April 16'" event If not, why? <br />4. Will there be periodic safety inspections? By whom and how often? <br />5. What are the fire safety requirements? This site is adjacent to heavily wooded properties with no fire hydrants <br />nearby. <br />6. What are requirements for reporting spills? What are the penalties for not reporting spills in a timely manner? <br />7. What type and how much training will owners, managers and employee's undergo prior to starting <br />operations? <br />8. How much liability does the company have in the event of air, soil or groundwater contamination? What are <br />the liability insurance requirements? <br />If you have answers to any of the above questions, please "respond to all" so everyone can see responses. <br />
