,;'u'a 13 ,r 379® (iii) If the County shall breach any of the terms of this agreement. County hereby acknowledges that the foregoing rights reserved to the City are conditions precedent to the making of this contract and sale and delivery of water provided for herein. (b) County agrees to design and install one lift station on the transmission line at the location shown on the attached map. The station will be designed to supply water to the mid section of line at an elevation to be compatible to the City's system elevation. The City shall have the right to inspect and approve the plans of said lift station and shall have the right to inspect said project at all stages of construction. The county will own and maintain the lift station and agrees to have it completed and operational by November 1, 1990. (c) The County shall transfer to the City the ownership of the water transmission lines described in Section (5) of this agreement free and clear of any liens and liabilities after twenty (20) years from the date of this agreement. (d) County will not use, nor will it permit any of its customers to use any water purchased from City pursuant to this agreement for processing purposes by a manufacturing or industrial facility without the prior written consent of City. The City may attach special conditions to any such consent, including a direct, recurring charge payable by such facility to City, based upon water consumption by such facility or other factors deemed by City to be appropriate.
