"Ns 13 ,rr 374 <br />STATE OF NORTH CAROLINA <br />COUNTY OF LEE <br />THIS AGREEMENT, made and entered into this the <br />day of , by and between the CITY OF SANFORD, a <br />municipal corporation chartered by the State of North Carolina, <br />and located in Lee County, North Carolina, hereinafter referred <br />to as "City", and the COUNTY OF LEE, a municipal corporation <br />chartered by the State of North Carolina, and located in North <br />Carolina, hereinafter referred to as "County". <br />WITNESSETH: <br />WHEREAS, City operates a water system, and presently <br />has a surplus of treated water, and is willing to sell to the <br />County, a portion of said surplus water, upon the terms and <br />conditions hereinafter set forth; and <br />WHEREAS, the County is willing to purchase water from <br />the city upon the terms and conditions set forth; <br />NOW, THEREFORE, in consideration of the premises, the <br />mutual promises herein contained; and the sum of Ten Dollars, <br />each to the other paid; the parties have mutually agreed as <br />follows: <br />1. City agrees to sell to the County at a point of <br />delivery located at intersection of Cool Springs Road (SR 1326) <br />and Valley Road (SR 1325), in Lee County, North Carolina, potable <br />treated water, satisfying applicable purity standards of North <br />Carolina Division of Health Services at an approximately <br />constant, normal gravity pressure, based upon and elevated storage <br />
