their next meeting. <br />Mr. Leonard Barefoot, <br />Mr. Barefoot presented the <br />on rezoning petitions which <br />public hearing on September <br />19 <br />Boor; 13 - 3e5 <br />Director Planning, was recognized. <br />recommendations of the Planning Board <br />were reviewed during the joint <br />17th. <br />The first petition was a request to rezone 52.65 acres of <br />land located at the end of Brown Road adjacent to the Norfolk <br />and Southern Railroad from Light Industrial District to Heavy <br />Industrial District. The petition was submitted by the owner, <br />C. P. Properties, Inc. The Planning Board recommended that the <br />rezoning request be approved. Commissioner Matthews moved to <br />approve the recommendation of the Planning Board. Commissioner <br />Cox seconded the motion and upon a vote the results were as <br />follows: <br />Aye: Cox, Matthews, Stafford and Wicker <br />Nay: None <br />The Chairman ruled the motion carried unanimously. <br />The second petition was a request to rezone approximately <br />10 acres of land located at the end of Brown Road adjacent to <br />the Norfolk and Southern Railroad from Light Industrial District <br />to Heavy Industrial Conditional Use District. The petition was <br />submitted by American Refuse System Waste Management Tire <br />Recycling, Ltd. The Planning Board unanimously recommended that <br />the conditional use permit be approved subject to the following <br />conditions: <br />1. A copy of the lease with C.P. Properties mandating that <br />ARS will be responsible for all clean up of the property upon <br />closure of the temporary tire shredding facility be made a part <br />of the Planning Board record. <br />2. The maximum amount of whole tires, in-process material, <br />and scrap on hand will not exceed 70,000 tires. <br />3. Tires to be stored in individual piles will not exceed <br />5000 tires per pile and will be separated by fire lanes. <br />4. Tires will be processed within ten (19) days or must be <br />covered by six (6) mil plastic. At no time will a tire be on <br />site for more than thirty (30) days. <br />5. Noise level at the facility perimiter will be <br />maintained at 75 decibles or less. <br />6. The facility will be manned by an employee or guard <br />service 24 hours a day, year round. <br />7. ARS will agree in writing to make available to the <br />Northview Volunteer Fire Department at ARS's expense all <br />equipment, supplies, utilities, and training necessary to <br />3 <br />
