- <br />LEE COUNTY 2006 <br />Committed Today for a Better Tomorrow <br />RESOLUTION IN SUPPORT OF DIVIDING <br />THE ELEVENTH JUDICIAL DISTRICT <br />WHEREAS, the Eleventh Judicial District for District Court and the Eleventh Judicial District for <br />Prosecutorial Districts consist of Johnston, Harnett, and Lee Counties; and <br />WHEREAS, for the purpose of Superior Court, the Eleventh Judicial District has been split into <br />11A consisting of. Lee and Harnett Counties and 11 B consisting of Johnston County; and <br />WHEREAS, Johnston County has 85,087 registered voters; Lee County has 28,906 registered <br />voters; and Harnett County has 55,253 registered voters; so that the number of registered <br />voters in Johnston County exceeds the total number of voters in Harnett and Lee Counties <br />combined (84,159); and <br />WHEREAS, in the past, the people of Lee County have been unable to elect a. Judge or a <br />District Attorney who is a resident of Lee County, based on the sheer number of voters; and <br />WHEREAS, in order to reduce the backlog of cases, to reduce the number of cases dismissed, <br />to be more responsive to the victims of crime and to assist with identifying repeat offenders and <br />habitual offenders; and <br />® WHEREAS, in order to reduce travel time within the district; to create a more manageable -sized <br />jurisdiction; and to provide judicial administration which is in closer touch with the people of the <br />district; the Lee County Board of Commissioners believes a division of the district court and <br />prosecutorial districts into 11A and 11 B will create a more effective administration of justice; and <br />WHEREAS, division of the district into 11A and 11B would make the District Court and <br />Prosecutorial District consistent with.the Superior Court Judicial District; and <br />WHEREAS, Article IV Sections 10 and 18 of the North Carolina Constitution state that "the <br />General Assembly shall, from time to time, divide the state into a convenient number of local <br />court districts..." and "a convenient number of prosecutorial districts...." <br />NOW, THEREFORE, the Lee County Board of Commissioners respectfully requests that the <br />General Assembly divide the Eleventh Judicial District into 11A consisting of Lee and Harnett <br />Counties and into 11 B consisting of Johnston County, as expeditiously as oossible. <br />Adopted this 19` day of June 2006. <br />Herbert A.
