® L~,oos 13 562 <br />by the Planning Board. Commissioner Reives asked if a request to <br />extend a carnival longer than ten days was made, what the proper <br />procedure would be. Mr. Barefoot stated that a public hearing would <br />have to be held for the special use. Commissioner Reives stated <br />that this process would involve too much time. Mr. Barefoot stated <br />that the wording could be changed to reflect that approval from the <br />Planning Board would need to be obtained for any need beyond ten <br />days. Commissioner Hall stated that the amendment could reflect <br />that for additional time, the Planning Director could be authorized <br />by the Planning Board to issue a permit to extend the time in ten <br />day increments. Ms. Dickerson stated that a time limit should be <br />specified and suggested renewal for an additional ten day period. <br />Commissioner Hall suggested changing the proposed amendment to allow <br />renewing the special use permit in ten day periods. Mr. Barefoot <br />stated that making a request for a special use permit is not a <br />cumbersome procedure. Mr. Barefoot stated that if some limitations <br />are not set, the County will not have the control that it needs in <br />this situation. <br />Chairman Stafford stated that the Board wants to be able to <br />serve the public and not to be restrictive. He stated that the <br />Board of Commissioners would probably consider allowing Mr. Barefoot <br />authority to consider an additional ten day period and any <br />subsequent periods would have to be reviewed by the Planning Board. <br />Chairman Stafford directed the County Attorney to arrange the <br />wording for the amendment so that the Board may take action later <br />during the meeting. <br />The Chairman opened the floor to all persons wishing to speak <br />in favor of or in opposition to the request. There being no one <br />present to speak, Commissioner Wicker moved that the public hearing <br />be closed. Commissioner Cox seconded the motion, and upon a vote, <br />the results were as follows: <br />Aye: Cox, Hall, Matthews, Paschal, Reives, Stafford, and <br />Wicker <br />Nay: None <br />The Chairman ruled the motion adopted unanimously. <br />Commissioner Hall moved to open a public hearing with the <br />Planning Board for a petition to rezone from Residential <br />Agricultural District to Highway Commercial District three acres of <br />land on the western side of US Highway 1/15-501 South at 2424 <br />Jefferson Davis Highway, and being the same property depicted on Tax <br />Map 9631.03, Parcel ID Numbers 9631-31-8852 and 9631-32-9013, Lee <br />County Land Records Office. The petition was submitted by Edward L. <br />Bullard, Jr., for Waylon Mitchell Jackson. Commissioner Cox <br />seconded the motion, and upon a vote, the results were as follows: <br />Aye: Cox, Hall, Matthews, Paschal, Reives, Stafford, and <br />Wicker <br />Nay: None <br />The Chairman ruled the motion adopted unanimously. <br />3 <br />
