0 coos 561 <br />Aye: Cox, Hall, Matthews, Paschal, Reives, Stafford, and <br />Wicker <br />Nay: None <br />The Chairman ruled the motion adopted unanimously and the <br />public hearing open. <br />Mr. Leonard Barefoot, Planning Director, presented these <br />proposed amendments as recommended by the Planning Board. Mr. <br />Barefoot stated in reference to Item B above that the only Community <br />Shopping District in the County is in downtown Lemon Springs. As <br />the Ordinance currently stands, out-of-doors, commercial amusements <br />would be allowed on that property, which the Planning Board feels <br />would not be appropriate. In reference to Item D above, Mr. <br />Barefoot stated that currently restaurants are permitted only in the <br />Highway Commercial and Community Shopping Districts. He stated that <br />the amendment of Section 3, Article XIII, would increase the time <br />for individuals needing a temporary occupancy permit to underpin <br />Class B and Class C mobile homes. Thirty days has proven not to be <br />sufficient time to complete this job. The State Building Code has <br />been amended to allow sixty days for completion, and the proposed <br />amendment would coincide with the State Code. <br />Commissioner Cox asked Mr. Barefoot if there are any specific <br />reasons for making these amendments. Mr. Barefoot stated that there <br />are no specific reasons; however, a particular rezoning request <br />raised some issues about uses permitted and not permitted in highway <br />commercial districts. Regulations for adult entertainment <br />establishments are still pending and will be presented to the <br />Planning Board at a later date. <br />Commissioner Cox asked Mr. Barefoot if he perceives the changes <br />as being prejudicial to any particular groups or individuals. Mr. <br />Barefoot stated that most of the changes would not directly affect <br />anyone. <br />Commissioner Hall asked if the ten day permit issuance for <br />carnival rides was too restrictive. Mr. Barefoot stated that <br />individuals wishing to extend the permit beyond ten days, would <br />appeal to the Planning Board for a special use permit. The Planning <br />Board felt that ten days was sufficient time to conduct a carnival. <br />Commissioner Hall stated that at times shopping centers will hire <br />carnival rides for promotional purposes or civic clubs will sponsor <br />carnivals for fund raisers. <br />Chairman Stafford asked if a group or individual could divide <br />this ten day permit into two five day periods during the year. Mr. <br />Barefoot stated that the time could be divided, and that if the <br />Board feels that ten days is not sufficient, it may change the <br />number of days specified. <br />Commissioner Wicker stated that the permit should be allowed <br />for more than ten days or possibly be left open. Ms. Celia <br />Dickerson, Chairman of the Planning Board, stated that this would be <br />a temporary permit, to be extended by a special use permit granted <br />2 <br />
