eoo,. 13 r-Au 584 <br />to meet private road standards. Private road standards require <br />a travel way width of 16' of stone and a 50' right-of-way, with <br />appropriate ditches and slopes. Mrs. Southern would dedicate <br />the 50' right-of-way to a property owners' association <br />consisting of the Southerns and those individuals owning the <br />property to the rear of the Southerns' property. Mrs. <br />Southern's attorney will draft the property owners' association <br />agreement which will resolve an issue for a road that could <br />present problems later. Commissioner Wicker asked if the 50' <br />right-of-way would feed into a 60' right-of-way. Mr. Barefoot <br />stated that Gatewood Subdivision has a 60' right-of-way, <br />however, the NC DOT accepts a 50' right-of-way. All secondary <br />roads are accepted by the NC DOT with 50' rights-of-way. Since <br />there are fees involved in the preparation of the property <br />owners' association agreement and the map corrections, Mr. <br />Barefoot requested that the Board of Commissioners acknowledge <br />that they will approve the final plans of this variance request <br />when the Planning Board officially presents the request to them <br />at a later date. <br />Chairman Stafford stated that Southern Road would end in a <br />cul-de-sac and is not foreseen as an interconnecting road. <br />Consideration of this request would benefit the current <br />residences abutting to the property in question, enhancing <br />their property, as well as the Southerns' property. <br />Commissioner Paschal asked if the property owners of <br />Gatewood Subdivision are in full agreement with this request. <br />Mr. Barefoot stated that five of the property owners attended <br />the meeting and indicated that there would be no problems with <br />the request. Commissioner Wicker asked if the State will be <br />requested to build the road. Mr. Barefoot stated that the <br />Southerns agreed to dedicate the rights-of-way as a private <br />road serving their property and the Gatewood Subdivision <br />property owners. As a part of this agreement , a maintenance <br />agreement will be required by all property owners. <br />Commissioner Wicker asked if the State will be requested to <br />build the road. Mr. Barefoot stated that the property owners <br />will build and maintain the road. <br />Commissioner Hall moved to adopt the recommendation of the <br />Planning Board to grant a variance from the Subdivision <br />Ordinance to allow one two-acre lot to be created, which is <br />less than the three-acre requirement, and to accept the <br />existing standards of Southern Road, which does not meet the <br />Ordinance's requirements of private roads, with the <br />anticipation of final approval at a later date. Commissioner <br />Reives seconded the motion, and upon a vote, the results were <br />as follows: <br />Aye: Cox, Hall, Matthews, Paschal, Reives, Stafford, and <br />Wicker <br />Nay: None <br />The Chairman ruled the motion adopted unanimously. <br />7 <br />
