County Manager Cowan <br />stated that when a job reduction occurs, it does not <br />necessarily mean that the person in that position will lose <br />their job. Seniority, work performance, and other factors <br />determine who is actually laid off. Therefore, a person is <br />entitled to an appeal to ensure himself through due process <br />that he was the appropriate individual to be eliminated. <br />Commissioner Reives stated that this is a safeguard for the <br />employee, as well as for the County. Commissioner Hall <br />questioned the policy of unlimited accumulation of sick leave. <br />County Manager Cowan briefly explained the benefit of this <br />policy to the employee and stated that the State adhers to the <br />same policy for sick leave. <br />Commissioner Reives moved to adopt the following <br />resolution: <br />IMPLEMENTATION OF PERSONNEL POLICY BY RESOLUTION <br />PERSONNEL POLICY RESOLUTION <br />COUNTY OF LEE, NORTH CAROLINA <br />Section 1. <br />Be it resolved that all policies, ordinances or <br />resolutions that conflict with the provisions of this Policy <br />are hereby repealed. <br />Section 2. <br />Be it further resolved that if any provision of this <br />policy or any rule, regulation or order thereunder or the <br />application of such provision to any person or circumstance is <br />held invalid, the remainder of this Policy and the application <br />of such remaining provisions of this Policy of such rules, <br />regulations or orders to persons or circumstances other than <br />those held invalid, will not be affected thereby. <br />Section 3. <br />Be it further resolved that this Personnel Manual, dated <br />February 4, 1991, be adopted as an Administrative Policy and it <br />is not intended to create a property interest in continued <br />employment or to provide an exception to the <br />"employment-at-will" rule. <br />Section 4. <br />Be it further resolved by the Board of County <br />Commissioners of Lee County that the foregoing rules and <br />regulations shall govern the appointment, classification, <br />salary, promotion, demotion, dismissal, and conditions of <br />employment of the employees of Lee County. <br />Section 5. <br />14 <br />
