2010 - > <br />LEE O <br />C ommitted Today <br />RESOLUTION <br />AUTHORIZING TRANSFER OF INTEREST OWNED BY <br />LEE COUNTY IN A TRACT OF REAL ESTATE IN <br />EAST SANFORD TOWNSHIP TO THE CITY OF SANFORD <br />WHEREAS, American Performance Industries, Inc. (API) filed for bankruptcy in the <br />Bankruptcy Court of the Middle District of North Carolina; and <br />WHEREAS, the Bankruptcy Court abandoned certain property in East Sanford <br />Township, Lee County, as an asset in said proceedings; and <br />WHEREAS, the City of Sanford deemed the abandoned property to be in such condition <br />that it was hazardous to the general public and an attractive nuisance to children; and <br />WHEREAS, the City of Sanford at its sole expense had the dilapidated structures and <br />• debris removed from the sites; and <br />WHEREAS, thereafter the City of Sanford and Lee County brought a tax foreclosure <br />action against API and Damsmith Corporation and others which was filed in the District Court <br />in Lee County under 10 CVD 490; and <br />WHEREAS, judgment for plaintiffs was entered and the property hereinafter described <br />was sold at public auction to the City of Sanford and the County of Lee and the Deed was <br />recorded in Book 1220 at Page 970 in the Lee County Registry; and <br />WHEREAS, the City of Sanford has offered to seek a Brownfield Agreement with the <br />North Carolina Department of Environment and Natural Resources at its expense to improve <br />the merchantability of the project; and <br />WHEREAS, the Board of Commissioners recognize the demolition work and the <br />Brownfield Agreement would materially help to induce an investor to purchase the property; <br />NOW, THEREFORE, BE IT RESOLVED that the Lee County Board of Commissioners <br />does authorize and direct its officers to execute and deliver to the City of Sanford a Deed of <br />Conveyance for its interest in the following tract of land without any further consideration: <br />BEGINNING at an iron stake at a point where the southern line of Maple <br />Avenue intersects the western line of Second Street (formerly Foundry <br />• Street); thence with the western line of Second Street South 12 degrees <br />
