WHEREAS, Mr. Martin submitted a second upset bid on August 31, 2018 in the amount <br />of $2,000.00 and he paid the requisite 5 percent (5%) deposit and advertising costs on his second <br />upset bid; and, <br />WHEREAS, the Lee County Board of Commissioners accepted the second upset bid <br />offer of $2,000.00 at the regular meeting on September 17, 2018 and authorized staff to advertise <br />the second upset bid in the newspaper; and, <br />WHEREAS, the second upset bid of $2,000.00 was advertised in The Sanford Herald on <br />September 26, 2018; and, <br />WHEREAS, no further upset bids were received during the ten day upset bid period and <br />the second upset bid of $2,000.00 from Mr. Martin is the final and highest bid received. <br />NOW, THEREFORE, BE IT RESOLVED by the Lee County Board of Commissioners <br />as follows: <br />The Lee County Board of Commissioners hereby accepts the offer of $2,000.00 from <br />Charlies Martin. <br />2. The terms of the final sale are as follows: <br />a. The buyer must pay with cash, cashier's check or certified check at the time of <br />closing. <br />b. The property is sold "as is" with no conditions placed on the bid. <br />c. Title to the subject property shall be transferred to the buyer by a non -warranty <br />deed. <br />d. Advertising costs are non-refundable. <br />e. The County Attorney does not perform title searches on the property and the <br />Offeror can retain their own attorney to perform such title search. <br />3.
