WHEREAS, The City of Sanford has a Fire Department with stations located in geographic locations within Lee County from which the City can provide adequate fire protection and rescue services to the proposed Clearwater Fire Protection and Rescue Service District; and WHEREAS, the Law and Finance Committee of the Sanford City Council at its June 15, 2011 meeting expressed, by consensus opinion, approval of an inter -local agreement between the City of Sanford and Lee County, the term of which is renewable annually upon consent of the parties, to provide fire protection and rescue services to the proposed Clearwater Forest Fire Protection and Rescue Service District, such services being similar to those provided to property owners and residents within the city limits for $36,000 during Fiscal Year 2010 -2011, and which would improve the area's fire protection class rating. NOW THEREFORE BE IT RESOLVED, by the Lee County Board of Commissioners as follows: 1. The Board does hereby make the following findings based upon (i) the report provided to the Board pursuant to North Carolina General Statute 153A -302; (ii) comments made at the June 15, 2011 public hearing; and, (ii) additional evidence and information received by the Board: • (a) A demonstrable need for fire protection and rescue services exists within the proposed Clearwater Forest Fire Protection and Rescue Service District; (b) It is impossible or impracticable to provide fire protection and rescue services on a county -wide basis; (c) It is economically feasible to provide fire protection and rescue services in the proposed Clearwater Forest Fire Protection and Rescue Service District without unreasonable or burdensome annual tax levies; and (d) There is a demonstrable demand for fire protection and rescue services by the property owners and persons residing in the proposed Clearwater Forest Fire Protection and Rescue Service District. 2. Based upon the foregoing findings and in accordance with the Act, the Board does hereby establish and define a tax supported service district for the provisions of fire protection and rescue services, which district is named the Clearwater Forest Fire Protection and Rescue Service District and does hereby define the District as including the territory shown on the attached map marked as Exhibit A which is incorporated by references as if fully set out herein. • 3. The Board decrees that the establishment of the Clearwater Forest Fire Protection and Rescue Service District shall have no effect on the existence of the Cape Fear
