• for the district; and all other matters the Board believed to have a bearing on whether the <br />proposed district should be established; and <br />WHEREAS, because the proposed Cape Fear Fire Protection and Rescue Service District <br />would include territory lying within the municipal limits of the Town of Broadway, a resolution <br />of the governing body of the Town consenting to such inclusion has been duly adopted and the <br />resolution is incorporated by reference as if fully set out herein and attached as Exhibit A; and <br />WHEREAS, The Cape Fear Rural Fire Department has stations located in geographic <br />locations within Lee County from which the Department can provide adequate fire protection <br />and rescue services to the proposed Cape Fear Fire Protection and Rescue Service District; and <br />WHEREAS, the officers of the Cape Fear Rural Fire Department have expressed a <br />willingness and ability to provide fire protection and rescue services to the proposed Cape Fear <br />Fire Protection and Rescue Service District which would maintain the fire protection class rating <br />of the property within the proposed District. <br />NOW THEREFORE BE IT RESOLVED, by the Lee County Board of Commissioners as <br />follows: <br />1. The Board does hereby make the following findings based upon (i) the report <br />• provided to the Board pursuant to North Carolina General Statute 153A -302; (ii) comments <br />made at the June 15, 2011 public hearing; and, (ii) additional evidence and information <br />received by the Board: <br />(a) A demonstrable need for fire protection and rescue services exists within the <br />proposed Cape Fear Fire Protection and Rescue Service District; <br />(b) It is impossible or impracticable to provide fire protection and rescue services on <br />a county -wide basis; <br />(c) It is economically feasible to provide fire protection and rescue services in the <br />proposed Cape Fear Fire Protection and Rescue Service District without unreasonable or <br />burdensome annual tax levies; and <br />(d) There is a demonstrable demand for fire protection and rescue services by the <br />property owners and persons residing in the proposed Cape Fear Fire Protection and <br />Rescue Service District. <br />2. Based upon the foregoing findings and in accordance with the Act, the Board <br />does hereby establish and define a tax supported service district for the provisions of fire <br />protection and rescue services, which district is named the Cape Fear Fire Protection and <br />• Rescue Service District and does hereby define the District as including the territory shown on <br />
