IV. PRESENTATIONS FROM FIRMS PARTICIPATING IN OPIOID LITIGATION <br /> A. Presentation from Simmons, Hanley, Conroy/Crueger Dickinson <br /> Amy Garret with Simmons, Hanley, Conroy, presented in response to a request for <br /> proposals with information on the history and legal theories associated with the opioid <br /> litigation. There are three main firms involved in this litigation team. Ms. Garret provided a <br /> Powerpoint Presentation with information on the Opioid litigation including statistics, the <br /> parties affected by it, and the cause. The defendants of the lawsuits include manufacturers <br /> and distributors of opioid medications. There are hundreds of Counties that have filed suit <br /> at this point. North Carolina plaintiffs will take part in the federal multi-district litigation <br /> (MDL). Cases are first filed in federal court and then generally transferred to the MDL. <br /> There are two tracts—the settlement track and the litigation track. The proposed legal fee <br /> is based on a 25% contingency fee arrangement, with costs capped at 10%. No action was <br /> taken. <br /> B. Presentation from McHugh Fuller Law Group <br /> Chip Post with Post, Foushee, Patton Law Firm, began the presentation by introducing <br /> himself. The national firms have chosen to retain local counsel to be the point of contact in <br /> places they represent. Amy Quaison, attorney with McHugh Fuller Law Group, provided <br /> information regarding the litigation. The contingency fee and costs are the same at a 25% <br /> contingency fee arrangement with costs capped at 10%. There are five main firms involved <br /> in litigation team not including local counsel. Paul Farrel is the lead attorney of the <br /> litigation team. The first case will be tried in Ohio in March 2019. No action was taken. <br /> V. OLD BUSINESS <br /> A. Consideration of an offer to purchase property located on Hooker Street, Sanford, <br /> NC, PIN 9642-54-4884-00 <br /> At the June 18, 2018 Regular Meeting, the Board of Commissioners declared <br /> property located on Hooker Street, Sanford, NC, PIN 9642-54-4884-00 as surplus, then <br /> authorized staff to accept the initial offer of$800.00 from Brick Capital Community <br /> Development Corporation and advertise the offer in The Sanford Herald. The offer was <br /> advertised in The Sanford Herald on July 5, 2018. There were no upset bids received. <br /> Commissioner Oldham moved to accept the offer from BCCDC as final and authorize the <br /> Chair to sign any associated documents, a copy of which is attached to these minutes and <br /> by this reference made a part hereof. Upon a vote, the results were as follows: <br /> Aye: Dalrymple, Dodson, Knecht, Oldham, Reives, Sharpe, Sloan <br /> Nay: None <br /> The Chair ruled the motion had carried unanimously. <br /> B. Consideration of an offer to purchase property located on Lemon Springs Road, <br /> Sanford, NC, PIN 9549-17-7784-00. <br /> County Attorney Whitney Parrish stated that Lee County foreclosed on property located <br /> at PIN 9549-17-7784-00 in 2017.
