While NC law and County policy mandate when written contracts are required, this does not <br /> preclude the use of written contracts at any time. It should also be remembered that the need for <br /> a contract might vary according to circumstances. <br /> All written contracts must be reviewed by the County's legal department. <br /> North Carolina Bid Requirements <br /> Formal Bid Requirements <br /> The County will follow the NC General Statutes governing the formal bid requirements (143-128) for <br /> purchase of supplies, materials and apparatus; and for building construction contracting and <br /> repairs. The County will observe the reporting procedures as required by the NC General Statutes <br /> for the required procedures. (Formal Bid guidelines attached see Policy List attachments) <br /> Exceptions to Bid Requirements <br /> On August 2, 2001, the North Carolina General Statutes regarding purchasing were amended to <br /> adhere to modem procurement practices.Included in the amendment were several exceptions for <br /> certain type purchases.This policy shall acknowledge and exempt those exceptions as listed below <br /> and authorize the County Manager to award such bids: <br /> 1. The purchase, lease, or other acquisition of any apparatus, supplies, materials, or <br /> equipment from any other government unit or agency thereof within the United States. <br /> 2. Cases of special emergency purchases involving the health and safety of the people or <br /> their property. <br /> 3. Purchases of information technology through contracts established by the State Office of <br /> Information Technology Services, <br /> 4. Purchases from contracts established by the State or any agency of the State,if the <br /> contractor is willing to extend to a political subdivision of the State the same or more <br /> favorable prices, terms, or conditions as established in the State contract. <br /> 5. Purchase of used apparatus,supplies, materials, or equipment. For purposes of this <br /> subdivision, remanufactured or refabricated apparatus,supplies, materials, or equipment <br /> are not included in the exception. <br /> Informal Bid Requirements <br /> The informal bidding requirements cover contracts for construction or repair work and contracts for <br /> the purchase or lease-purchase of apparatus, supplies, materials, or equipment involving the <br /> expenditure of $30,000 or more, but less than the limits prescribed by the formal bidding <br /> requirements. They may be obtained verbally, or by electronic or written submission. The Lee <br /> County standard is for informal bids over the $30,000 threshold to be written sealed bids. No <br /> advertisement is required.The Lee County standard is to at a minimum post any informal bid request <br /> on its website, Ieecountync.gov, for at least five (5) business days. The Lee County standard is to <br /> seek three quotes for all bids that do not qualify for the exception rules. The department or county <br /> must keep a record of all quotes sought, but not are not subject to public inspection until the bids <br /> are opened. The standard for awarding contracts is based on the "lowest responsible bidder, or <br /> bidders, taking into consideration quality, performance, and the time specified in the proposals for <br /> the performance of the contracts."
