A. <br />_ Information <br />Meeting Date: June 2, 2008 XX Action Item <br />Consent Agenda <br />SUBJECT: Regulation of Private Drinking Water Wells <br />DEPARTMENT: Lee County Health Department <br />CONTACT PERSON: Mike Hanes, Health Director <br />REQUEST: Approve to sun-set local well water rules and adopt State rules <br />effective July 1, 2008 <br />SUMMARY: In 2006 the North Carolina General Assembly passed legislation <br />directing the Environmental Management Commission to adopt rules for local health departments <br />governing the permitting, inspection, sampling and testing of private drinking water wells. The <br />new legislation goes into effect July 1, 2008, and. local health departments will be responsible for <br />enforcing the new regulations. <br />Lee County currently has its own well program that was passed by the Lee County Board of <br />Health over 30 years ago. The Lee County regulations are very similar to the new State rules with <br />few exceptions. Lee County could have chosen to have their own well regulations but they would <br />have had to be equal to or more stringent than the State rules, and by having local regulations, <br />the County would have to assume all liability for the program <br />BUDGET IMPACT: N/A <br />ATTACHMENT(S): Summary of the General Statutes and rules regulating private <br />drinking water wells and the requirements of local health departments. <br />PUBLIC HEARING: No <br />PRIOR BOARD ACTION: Thirty years ago. <br />RECOMMENDATION: Approve State Rules and Regulations <br />E <br />
