Crompton ® April 23, 2008 Page 9 of 11 o Change Order o Certificate of Substantial Completion o General and Supplemental general conditions o Technical Specifications • Issue written notice to proceed. • Review Contractor submittals (shop drawings). • Provide interpretation of construction plans. • Review and verify Contractor's pay request. • Prepare any required change order. • Submit progress reports to the Owner. • Provide construction administration and part-time construction observation services (average 40 hours per week for 26 weeks). • Schedule and conduct a final inspection. • Provide certification that construction generally conformed to approved plans and specifications. • Provide one reproducible set of record drawings from the Contractor's mark-up of as-built conditions to the Owner. • Provide one set of record drawings from the Contractor's mark-up of as- built conditions to NCDENR-Land Quality Section-Dam Safety. III. BASIS FOR COMPENSATION Fees will be invoiced monthly in accordance with the attached Schedule of Hourly Rates and due upon receipt consistent with the enclosed General Terms and Conditions- As discussed our fees are presented as Not To Exceed. We will not exceed the estimated fees without prior approval from Client. A summary of the maximum fees for each of the phases described above follows: For Phase 1, Investigation and Preliminary Design services including geotechnical, the Engineer shall be compensated a not to exceed fee of $ 42,380.00 including reimbursable expenses. (Please note that our fee estimates include the topographic surveys and geotechnical services). We have assumed that we will not need a barge to perform geotechnical services. For Phase 2, Design services, including the final dam safety report, design drawings and specifications, and permit application packages; the Engineer shall be compensated a not to exceed fee of $ 57,577.00 including reimbursable expenses.
