048 <br />® 2008-0201 <br />STAFF REPORT <br />Lee County Board of Commissioners and Planning Board <br />Public Hearing Information <br />For Consideration of an Application to rezone to a Conditional Zoning District <br />February 18, 2008 <br />Public Hearing Request: Rezone 20.38+- acres from the current Lee County Residential Agricultural <br />(RA) district to a Type 1 Conditional Zoning District to be known as the "Sloan Mountain Vineyards & <br />Winery Conditional Zoning District" <br />Applicants & Owners: Timothy & Suzette Sloan <br />Location: The property is located off Aveat's Perry Road, NC HWI 42 E, approximately <br />1,000 feet northeast of the intersection of Berke Thomas Road and Avent's <br />Perry Road. <br />Tax Parcel: The area proposed for rezoning is depicted on "fax Map 9671 a portion of Tax <br />Parcel 9673-73-4288, Lee County Land Records Office <br />Adjacent zoning North: Residential Agricultural (RA) <br />South: Residential Agricultural (RA) <br />East: Residential Agricultural (RA) <br />West: Residential Agricultural (RA) <br />r 1 <br />U <br />Site and Area Description <br />The site requested for rezoning consists of a 20.38-acre tract which is a portion of a 44.75-acre tract of <br />land. The site has 270.28 feet of road front on Avent's Perry, NC Flwy 42 E. The property is a bona- <br />fide farm (Farm No.3499) with grapevines/vineyards being the main crop. The tract appears to be light <br />to medium wooded. There is currently a single family dwelling located at die southern end of the <br />property that will be removed as noted on the site plan. <br />The project site is located in the northeastern portion of Lee County in the Cape Fear Township. The <br />site is more specifically in an area where farming is prevalent. 'the surrounding properties are similar to <br />the subject tract which is both residential and agricultural in nature. All adjacent properties are zoned <br />Residential Agricultural (RA) district. The tract is bordered by large undeveloped/farm tracts with the <br />majority of those tracts owned by the applicants. <br />The property is currently zoned Residential Agricultural (RA) District. The RA district is established to <br />provide areas for low density single-family uses, low intensity agricultural operations as well as agri- <br />business and supportive industrial and commercial uses. The 1ZA zoning protects and preserves valuable <br />agricultural areas, implements agricultural protection zoning, establishes performance standards for rural <br />businesses, preserves rural areas, preserves pasture land and agriculture, defines specific areas for rural <br />commercial uses, and identifies areas appropriate for agricultural preservation. <br />Bona-fide farms including animal production, crop production and support services are permitted uses <br />by right in the Residential Agricultural district. Other similar uses permitted by right in the RA district <br />® include, pottery manufacturing and sales, botanical gardens and arboreta, livestock sales/markets. <br />1 of 4 <br />Staff Report <br />
