C 212 <br />AN ORDINANCE AMENDING <br />THE LEE COUNTY UNIFIED DEVELOPMENT ORDINANCE <br />BE IT ORDAINED by the Board of Commissioners of the County of Lee, North Carolina that <br />the Unified Development Ordinance be, and it hereby is, amended as follows: <br />Section 1. Article 4. Zoning District Regulations, 'fable 4.7-1 Density and Dimensional <br />Regulations be rewritten to include the following additional note: <br />Note 7: Any ramp or other structure constructed to comply with the standards of the <br />Americans with Disabilities Act (ADA) or other similar Building Code requirement for <br />the purpose of providing handicap access to a building shall be exempt from the <br />required setbacks of this Table 4.7-1. <br />Section 2. Article 5. Supplemental Development Regulations, Section 5.1 Accessory Uses and <br />Structures, Subsection 5.1.3 be rewritten to include the following additional note: <br />Note 3: Any accessory structure that will be located within eighteen (18) inches of an <br />exterior wall of a principal structure, shall be required to meet the principal structure <br />setbacks as set forth in Table 4.7-1 of this Ordinance. <br />® Section 3. Article 5. Supplemental Development Regulations, Section 533 Telecommunications <br />Towers, Subsection 533.23 be rewritten as follows: <br />5.33.2.3 MINhWUM SETBACK AND TALL ZONE REQUIREMENTS <br />Towers shall conform to the following dimensional requirements: <br />(a) For towers located on the roof of a Structures, other than the base or supporting elements <br />of the tower, the tower shall not be more than 30% of the building height above the building, <br />or 75 feet above the building, whichever is less. The building or structure shall maintain the <br />normal setbacks of the zoning district. <br />(b) For towers mounted on the ground surface: <br />• The minimum setback from all property boundaries shall be equal to the maximum <br />height of the proposed tower. <br />• A fall zone shall also be established for each tower. The fall zone is defined as an area <br />within the subject property, which shall be maintained so as to be clear of any <br />buildings within an area equal to the maximum height of the proposed tower as <br />measured by a circle around the base of the tower. Buildings that are constructed for <br />the purpose of housing equipment in support of the communications equipment as <br />located on the tower shall be permitted within the fall zone. <br />Section 4. Article 5. Supplemental Development Regulations, Section 5.33 Telecommunications <br />® 1 owers be amended to include a new subsection 5.33.8 to be written as follows: <br />
