05 `3 <br />RECOMMENDATION OF THE PLANNING BOARD <br />• FOR A CHANGE TO THE OFFICIAL ZONIG MAP OF LEE COUNTY <br />PETITION 2007-0901 <br />Application by Tony Ray Blakeley to rezone from Residential Restricted (RR) district to <br />Residential Agricultural (RA) district two parceis located on Cedar Lane Road, described as Lee <br />Tax Parcels 9528-95-4979, 9528-95-6935 and further described as Lot 10 and Lot I 1 of Deer <br />Run Subdivision recorded in Plat Cabinet 7, Slide I OOC, Lee County Registry of Deeds. <br />A public hearing was held with the Planning Board on September 10, 2007 to consider this <br />request. At the public hearing Mr. Scott Blakeley, son of the applicant, spoke in support of the <br />rezoning request. Scott Blakeley stated that the lots will be combined into one parcel of land. <br />Mr. Blakely informed the Boards that he wishes to place a single-wide manufactured on the <br />property for his residence until such time he constructs a site built home. Mr. Blakeley also <br />stated that the area is rural residential and that other manufactured homes exists in the area. <br />No one appeared or spoke in opposition to this request. <br />RECOMMENDATION OF THE PLANNING BOARD: The Planning Board by a <br />unanimous vote recommends that the Board of Commissioners approve the application to <br />rezone Tax Parcels 9528-95-4979 and 9528-95-6935 from Residential Restricted (RR) <br />district to Residential Agricultural (RA) district. <br />• Land use information presented at the public hearing is listed below for your reference. <br />Site and Area Description <br />The area petitioned for rezoning consists of two lots that are 2.05+- acres combined and located <br />south of Cedar Lane Road, SR 1182. Each lot has over 150 feet of road frontage on Cedar Lane <br />Road, a NCDOT maintained street. <br />All adjoining properties are residentially zoned and are either residential agricultural or <br />residential restricted district. A vacant 61+-acre tract adjoins the subject lots to the south. <br />Housing types in the area consists of double-wide manufactured homes and site-built homes. <br />The site has access to public water by means of a waterline in the right-of-way of Cedar Lane <br />Road. Waste water will be met by a private septic system. <br />Staff Analysis <br />The subject lots are a result of an 8234-acre tract that was rezoned in 1992 from Residential <br />Agricultural District to Residential Restricted (RR) district for the development of a major <br />subdivision. To date, one final plat was recorded that encumbered three sections of the proposed <br />development. When this property was rezoned to RR, the minimum housing type allowed at that <br />time was a Class A doublewide manufactured home. In September 1996, a zoning text <br />amendment was approved that deleted manufactured homes in its entirety as a permitted use in <br />the RR zoning district. <br />• Currently, the property is zoned Residential Restricted (RR) district.
