Conservation Easement-Gum Fork Creek
A conservation easement is proposed along Gwn Fork Creek within the Park.
Please see the enclosed map showing the casement location (note that the map is in
draft form). The purpose of the easement will be to perpetually preserve a riparian
buffer along this stream that is otherwise not required to be protected by existing
local, state, orfederal regulations.
The section of stream within the proposed easement is perennial and is within one
stream order of the impacted streams. Also, the land within the proposed easement
is currently in its natural state and no additional plantings are proposed-
A conserv. Payment to EEP
If additional mitigation is required, the County will consider utilization of mitigation
credit to EEP.
C. Stormwater Management Plan for Park
To the extent within the County's authority, appropriate covenants will be
developed and recorded for property within Ute Park that would require any new
development to construct and maintain Stormwater Best Management Practices
(BMP). Stormwater BMP's for new development in the Park are currently not
required by existing local, state, or federal regulations-
The requirements will stipulate that stormwater nmofffrom impervious areas must
be treated by a BMP designed to meet 85% removal of total suspended solids (TSS)
(designed per DWQ's Best Management Practices Manual) prior to discharge into
jurisdictional waters. No BMP can be constructed within jurisdictional waters or
conservation easements. It is proposed that BMPs will be owned, operated, and
maintained by the property owner. An operation and maintenance agreement will
be executed with BMP owners.
is No mitigation credit is proposed for this activity.
-5-
