® A. Conservation Easement - Gum Fork Creek <br />A conservation easement is proposed along Gum Fork Creek within the Park. <br />Please see the enclosed map showing the easement location (note that the map is in <br />draft form). The purpose of the easement will be to perpetually preserve a riparian <br />buffer along this stream that is otherwise not required to be protected by existing <br />local, state, or federal regulations. <br />The section of stream within the proposed easement is perennial and is within one <br />stream order of the impacted streams. There is <br />5,200 linear feet of stream available to be placed in the conservation easement. The <br />County proposes Monitoring Level 3 for future reporting to the USACE and <br />NCDWQ. <br />® B. Payment to EEP <br />If additional mitigation is required, the County will consider utilization of mitigation <br />credit to EEP. <br />C. Stormwater Management Plan for Park <br />To the extent within the County's authority, appropriate covenants will be <br />developed and recorded for property within the Park that would require any new <br />development to construct and maintain stormwater Best Management Practices <br />(BMP). Stormwater BMP's for new development in the Park are currently not <br />required by existing local, state, or federal regulations. <br />The requirements will stipulate that Stormwater runoff from impervious areas must <br />be treated by a BMP designed to meet 85% removal of total suspended solids (TSS) <br />(designed per DWQ's Best Management Practices Manual) prior to discharge into <br />jurisdictional waters. No BMP can be constructed within jurisdictional waters or <br />conservation easements. It is proposed that BMPs will be owned, operated, and <br />maintained by the property owner. An operation and maintenance agreement will <br />be executed with BMP owners. <br />® No mitigation credit is proposed for this activity. <br />5- <br />
