Compliance Issues <br />1. Lee County is out of compliance of its Nationwide 404 permit for <br />construction of road and sewer at the Park. <br />® 2. Draft letter submitted to Corps of Engineers and Division of Water <br />Quality for compliance of Nationwide Permit 14 (attached). <br />3. Need a stream mitigation plan for restoring impacted stream and <br />completion of mitigation items listed in the draft proposal. <br />4. Submit application for 401 permit to NC Division of Water Quality <br />concurrent with remediation plan of the Corps of Engineers. <br />B. Wetlands Certification <br />1. Survey all identified wetlands <br />2. Survey boundary of Industrial Park <br />Compliance issues listed under "A" need to be completed to avoid potential <br />permitting problems for future projects and fines. MS Consultants and other <br />engineering firms have suggested that the draft letter response to the Corp of <br />Engineers be revisited and revised to avoid having to construct a bridge over an <br />impacted stream. <br />There are substantial costs associated with the compliance issues. The <br />wetlands certification including survey work will also be costly and will need to be <br />done as soon as possible. The other suggests looking at the property <br />comprehensively and re-negotiating with the Corp of Engineers for options other <br />than building a bridge.
