0 <br />nlR D er,~j€ 784 <br />NORTH CAROLINA <br />LEE COUNTY LEASE <br />THIS LEASE, made this 6th day of May , 1991, by <br />and between the COUNTY OF LEE, party of the first part, <br />hereinafter called "Lessor", and CENTRAL CAROLINA COMMUNITY <br />COLLEGE, party of the second part, hereinafter called "Lessee"; <br />R E C I T A L S: <br />WHEREAS, Lessor lawfully owns and possesses certain real <br />property, hereinafter described; and, <br />WHEREAS, Lessee desires to lease the property, hereinafter <br />described; and, <br />WHEREAS, the parties desire to enter into a written lease <br />specifying the terms and conditions of a lease agreement between <br />them; <br />NOW, THEREFORE, Lessor, in consideration of the rent, <br />covenants and agreements, hereinafter mentioned to be kept and <br />performed by Lessee, does hereby lease and rent unto Lessee a <br />certain tract of real property located at Kelly Drive and Nash <br />Street known as the Lee County Civic Center and more particularly <br />described in Exhibit A which is attached hereto and incorporated <br />herein by reference together with the improvements situated <br />thereon, hereinafter referred to as "the Property", under the <br />following terms and conditions: <br />1. Duration; Rent: Lessor shall lease the Property to <br />Lessee for a term of three (3) years and one month, commencing on <br />May 6th, 1991, and expiring June 30, 1994. The rent shall be One <br />Dollar ($1.00) per year, beginning on or before the 10th day of <br />May, 1991. <br />2. Repairs: It is understood and agreed upon by the parties <br />that Lessee shall be responsible for damage caused to the <br />Property, ordinary wear and tear excepted, and shall repair the <br />same to good condition. <br />3. Limited, Unlawful Use: It is understood and agreed that <br />Lessee's use of the Property shall be limited to the purpose of <br />carrying out the programs of Lessee and civic functions incidental <br />thereto, unless permission is obtained from Lessor. Provided, <br />however, in the event Lessee ceases to use the Property for its <br />usual and customary programs for a period of six (6) months or <br />more, this Lease shall automatically terminate and Lessor may <br />reenter and take possession of the Property. <br />
