(b) Do not result in the displacement of currently employed workers, <br />including partial displacement, such as reduction in hours of non- <br />over-time work, wages, or unemployment benefits. <br />V <br />(c) Do not impair existing contracts for services or result in the <br />substitution of Federal funds for other funds in connection with <br />work that would otherwise be performed, including services <br />normally provided by temporary, part-time or seasonal workers or <br />through contracting such services out. <br />(d) Result in the creation of jobs that are in addition to those that <br />would be funded in the absence of assistance under the Act. <br />3.16.6. Other Financial Aid. The Contractor is required to identify training <br />costs supported by other Federal (DOL, PELL grants, WIN, VA, etc.) <br />State or-'local programs to ensure JTPA costs are reduced accordingly. <br />JTPA participants are encouraged to seek financial aid from other <br />sources and the Contractor should assist participants in the completion <br />of applications. However, in those cases where JTPA participants are <br />determined to be receiving other financial assistance, the Contractor <br />should ensure that double-billing for the same services does not occur. <br />This does not preclude the use of JTPA funds in conjunction with other <br />grants and aid where funds from the different sources are used to pay <br />for different services. <br />3.16.7. Refund Policy. The Contractor is required to establish a refund policy <br />when a JTPA participant in tuition-based training concludes early. <br />3.16.8. Lobbying- No Federal appropriated funds have been paid or will be <br />paid, by or on behalf of the Contractor, to anv person for influencing <br />or attempting to influence an officer or employee of an agency, a <br />member of Congress, an officer or employee of Congress, or an employee <br />of a Member of Congress in connection with the awarding of any Federal <br />contract, the making of any Federal grant, the making of any Federal <br />loan, the entering into of any cooperative agreement, and the <br />extension, continuation, renewal, amendment, or modification of any <br />Federal contract, grant, loan, or cooperative agreement. <br />If any funds other than Federal appropriated funds have been paid or <br />will be paid to any person for influencing or attempting to influence <br />an officer or employee of any agency, a Member of Congress, an officer <br />or employee of Congress, or an employee of a Member of Congress in <br />connection with this Federal contract, grant, loan, or cooperative <br />agreement, the Contractor shall complete and submit standard Form-LLL, <br />"Disclosure Form to Report Lobbying," in accordance with its <br />instructions. <br />3.17. Insurance/Bonding. <br />3.17.1. Bonding. The Contractor shall also procure a fidelity bond for all <br />JTPA staff and public agencies shall comply with their own agency's <br />bonding and insurance policies. Non-governmental agencies shall <br />procure either a blanket fidelity bond, or name schedule fidelity bond. <br />The bond limit shall be at least 5% of the amount outlined in <br />Paragraph 1.3 or $50,000, whichever is less. <br />-10- <br />
