906 <br />CONTRACT N0. 91-L-01 <br />Itsw CONTRACT FOR SERVICES <br />PROVIDED FOR UNDER TITLE II-A OF <br />THE JOB TRAINING PARTNERSHIP ALT <br />The Mid-Carolina Service Delivery Area (hereinafter referred to as the "SDA"), <br />designee of the Governor of North Carolina as the grant recipient and the <br />entity to administer the Governor's Coordination and Special Service Plan and <br />the Job Training Plan for the Kid-Carolina Service Delivery Area .(MSDA) under <br />the Job Training Partnership Act, and the Lee County Department of Aging <br />(hereinafter referred to as the "Contractor"), agree to <br />the follawipy"terms.- ` - .1 <br />PART I.,.;.:- <br />PURPOSE, PERIOD-MO CONSIDERATION <br />1.1. Purpose. The SDA agrees to engage the Contractor and the Contractor <br />agrees to perform the services set forth herein in connection with <br />activities to be operated and funded under the Job Training Partnership <br />Act, Public Law 97-300 (hereinafter:Act), Governor/Secretary Agreement <br />No. 23, and the Governor's Coordination and Special Services Plan and the Job Training Plan for the Mid-Carolina Service Delivery Area. <br />1.2. Period of Services. The services of the Contractor are to commence on <br />J111v 1 1991 , and shall be undertaken in such a manner as to <br />assure their completion, with the exception of closeout procedures, by <br />June 30 , 1992 . For the purpose of the statue of limitations, <br />and in recognition of the fact that closeout procedures, audit, audit <br />resolution and collection of disallowed costa will occur after the <br />services period, this Contract shall not be considered completed until <br />final action on disallowed costs by the .United States Department of <br />Labor has been taken and the time for appeal of disallowed costs has <br />expired. <br />1.3. Consideration. The SDA agrees, :subject to availability of federal <br />funds as obligated under the above referenced agreement and subject to <br />the conditions set forth herein, to pay this Contract, but in no event <br />will the total payments exceed the sum of Twenty-Nine Thousand Six <br />Hundred Fifty-Five and no/100----------------------- Dollars. (529,655.00) <br />PART II <br />DOCUMENTS AND DEFINITIONS <br />2.1. Documents Included in the Contract. The following documents are hereby <br />made a part of this Contract by reference, and compliance with the <br />applicable provisions of the documents is a condition of this Contracts <br />The Act and the regulations promulgated. thereunder; other applicable <br />federal laws, regulations, order, circulars and issuances: applicable <br />state laws, regulations, instructions and issuances; the contractor's <br />Proposal and attachments, the Assurances' and Certifications-and/--for <br />nongovernmental contractors, the special Bank Account Agreement. <br />
