Provide all criteria and full informal 1011 as to <br />OWNER's requirements for the Project, including de- <br />sign objectives and constraints, space, capacity and <br />performance requirements, flexibility and expandabil- <br />ity, and any budgetary limitations: and furnish copies <br />of all design and construction standards which <br />OWNER will require to be included in the Drawings <br />and Specifications. <br />3.2. Assist ENGINE[?R by placing at his disposal all <br />available information pertinent to the Plojccl including <br />previous reports and any other data relative to design <br />or construction of the Project. <br />3.3. Furnish to ENGINEER, as required for perfor- <br />mance of ENGINEER's Basic Services (except to the <br />extent provided otherwise in Exhibit A "Further De- <br />saiplion of Basic FllgillMing Services and Rclalcd <br />Matters"), data prepared by or services of od "I'll jn- <br />cluding without limitation cane borings, probings and <br />subsurface explorations, hydtographic surveys, labo- <br />ratory tests and inspections of samples, materials and <br />equipment; appropriate professional interpretations of <br />all of the foregoing; environmental assessment and im- <br />Pactstatcmcnls; property, boundary, etSCItlClll, righl- <br />of-way, topographic and utility surveys: property de- <br />scriptions; zoning, decd and other land use restriction; <br />and other special data or consultations no( covered in <br />Section 2; all of which ENGINEER may' rely upon in <br />performing his services. <br />3.4. Provide field euutiol surveys and eslal)[Hi ref- <br />crence poinls and base lines (excel,[ to the exlenl pro- <br />vided otherwise in Exhibit A "Further Description of <br />Basic Engineering Services and Rclalcd Matters") to <br />enable Contractor(s) to proceed with the layout of the <br />work. <br />3J. Furnish approvals and permits from all govern- <br />mental authorities having jurisdiclion over lire Project <br />and such approvals and consents from others as may <br />be necessary for completion of (he Project. <br />3.9. provide such accounting, independent cost esti- <br />mating :md insurance counseling services as may be <br />required [,,mire ['reject, such legal services as OWNER <br />may require or ENGINEER may reasonably request <br />with regard to legal issues pertaining to the Project <br />including any that may be raised by Contractor(s), such <br />auditing service as OWNER may require to ascertain <br />how or For what purpose ally Contractor has used the <br />moneys paid to him under the construction contract, <br />and such inspection services as OWNER may require <br />to ascertain that Contractor(s) are complying with any <br />law, rule or regulation applicable to their performance <br />of the work. <br />3.9. Designate in writing a person to act as OWN ER's <br />representative with respect to the services to be ren- <br />dered under this Agreement. Such person shall have <br />complete authority to transmit instructions, receive in- <br />lotimilion, inferprel and define 0WNER's policies and <br />decisions with respect to materials, equipment, ele- <br />ments and systems pertinent to ENGINEER's ser- <br />vices. <br />I, M. Give prompt written notice to ENGINEER <br />whenever OWNER observes or otherwise becomes <br />ewme of any development that affects (he scope or <br />timing of ENGINEER's services, or any defect in the <br />work of Contractor(s). <br />3.1 I. Furnish, ordirecl ENGINEER to provide, nec- <br />essary Additional Services as stipulated in Section 2 <br />of this Agreement or other services as required. <br />3.12.
