H <br />STATE OF NORTH CAROLINA, <br />COUNTY OF LEE <br />~qf3~ 14 T'r ,f 409 <br />THIS AGREEMENT, made and entered into this day of <br />1992, by and between the County of Lee hereinafter <br />referred to as County and Nova Medical Transport, Inc., <br />hereinafter referred to as Provider; <br />W I T N E S S E T H: <br />WHEREAS, Provider has made application for a franchise to <br />provide emergency and convalescent ambulance services in Lee <br />County, North Carolina; and <br />WHEREAS, the County is willing to grant a franchise upon <br />the terms and conditions set forth; <br />NOW, THEREFORE, in consideration of the premises and the <br />mutual promises herein contained, the parties have agreed as <br />follows: <br />1. Provider is hereby granted a one (1) year <br />non-exclusive franchise to operate a non-emergency and <br />convalescent ambulance service in Lee County, North Carolina, <br />in accordance with and while in compliance with the terms and <br />conditions set forth in the following documents, all of which <br />are incorporated herein by this reference, to-wit: <br />(a) Application filed by Provider <br />(b) Lee County Ordinance relating to the granting <br />of franchise for ambulance services in Book <br />of Ordinance 1, Page 163, et sect. <br />(c) Lee County Ordinance granting a non-exclusive <br />franchise to Nova Medical Transport, Inc. <br />(d) <br />All applicable State <br />Laws and <br />Regulations. <br />2. <br />This franchise is to <br />begin <br />1992 and to <br />terminate <br />. 1993. <br />3. Execution of this Agreement shall constitute <br />unconditional acceptance of this franchise and Provider's <br />promise to comply with and abide by all of its provisions, <br />terms and conditions. <br />IN WITNESS WHEREOF, the parties hereto have caused this <br />instrument to be executed by its appropriate officers, the day <br />and year first above written. <br />
