eoo~ 14 590 <br />for all communication between the County and the Society. <br />ARTICLE IV <br />Exclusive Arrangement <br />Section 4.1 Exclusive Arrangement. Society agrees that it <br />will not provide similar services for any other governmental <br />entity during the period while this agreement is in effect without <br />first obtaining the written permission of the County. <br />Section 4.2 Exclusive Ri hts. The County agrees that the <br />Society is to have exc usive rights to animals seized by the Lee <br />County Animal Control officer in the performance of his duties, <br />delivered to the animal shelter and accepted by the Society. <br />ARTICLE V <br />Section 5.1 Term. This agreement is for the period from <br />May 8, 1989, until May 31, 1992. <br />Section 5.2 Termination. Either party may terminate this <br />agreement without any urt er liability to the other party, by <br />giving such other party ninety (90) days written notice. <br />ARTICLE VI <br />Price for Service <br />Section 6.1 yro riation for Fiscal Year. The County has <br />appropriated the sum of 57,845.00 for such service for May 8, 1989 <br />to June 30, 1989. Said sum is to be paid in monthly increments of <br />$3,922.50, which shall be paid by the 10th day of each month to <br />compensate the Society for services rendered during that month. <br />The initial payment will be made May 10, 1989. <br />Section 6:2 Future A ro riations. For the fiscal year July <br />1, 1989 to June 30, 199 , the service fee to be paid by the County <br />to the Society shall be 551045.00, payable in monthly increments <br />of $4,278.75 each due on or before the'loth day of each month. <br />All subsequent monthly increments shall be paid by the 10th day of <br />each month. <br />The County agrees to a yearly inflationary increase as <br />reflected by the Consumer Price Index published by the U. S. <br />Department of Commerce to be the highest amount of either: <br />(1) CPI up to 58; or <br />(2) Equal increase of cost of living salary increases to <br />County employees with regard to cost of living raises. <br />Each yearly inflationary increase shall be effective as of <br />July 1 of each year, beginning July 1, 1990. <br />
